CEASE AND DESIST ORDER <br /> CITY OF TRACY <br /> "E. Provisions : <br /> "1 . Neither the discharge nor its treatment shall create a nuisance <br /> as defined in the California Water Code. <br /> "2. The discharger shall have and enforce a source control program <br /> approved by the Executive Officer which contains at least the <br /> powers and authorities contained in the State Water Resources <br /> Control Board's "Guidelines for Determining the Effectiveness <br /> of Local Source Control Programs" ." <br /> 3. Self-monitoring reports submitted by the City of Tracy reveal numerous <br /> violations of the above effluent limitations between July 1977 and <br /> February 1978. <br /> 4. Because of poor quality, the City discharged effluent to emergency holding <br /> ponds during two weeks in September 1977 and one week in November 1977. A <br /> portion of the industrial influent to the treatment plant has also been <br /> discharged to the holding ponds due to operational problems. The discharge <br /> of inadequately treated or untreated wastes to emergency holding ponds <br /> without adequate aeration capacity increases the likelihood of nuisance <br /> odors and constitutes a threatened violation of Provision E.1 of Order <br /> No. 77-182 listed in Finding #2 above. <br /> 5. During 1977, its first year of operation, the Tracy wastewater treatment <br /> plant has experienced operational problems and equipment malfunctions which <br /> have adversely affected essentially all phases of treatment and disposal . <br /> Negotiations are proceeding with the engineers , contractors , and suppliers <br /> to effect the repair of defective equipment. <br /> 6. The City Council of the City of Tracy on 24 March 1975 adopted Ordinance <br /> 395 C.S. which established the source control program required by Provision <br /> E.2 of Board Order No. 77-182. Ordinance 395 C.S. provides , in part, for <br /> the issuance of mandatory wastewater discharge permits by the City to <br /> certain industrial users with appropriate requirements for wastewater <br /> constituents , flow rates, mass emission rates , and monitoring. Section <br /> 5-6.105. (1 ) specifically prohibits the discharge of wastes to the sewer <br /> system "which cause, threaten to cause, or are capable of causing <br /> . quantities or rates of flow which overload the Agency's (City's) <br /> collection or treatment facilities . . .". <br /> 7. During the 1977 canning season a capacity study of the Tracy wastewater <br /> treatment plant was conducted by CH2M Hill , consulting engineers , which <br /> revealed that "The industrial BOD and suspended solids loading placed on <br /> the plant in 1977 greatly exceeded allocated quantities and resulted in <br /> a serious plant overload condition" . <br /> - 2 - <br />
