Implementation <br /> Actions and Implementation Responsibility for Oversight Agency Comments <br /> Mitigation Measure Timing Responsibility of Compliance/Verification Coordination <br /> hawks are known to have nested in within the <br /> past three years or trees,such as large oaks, <br /> which the hawks prefer for nesting)become <br /> occupied by a Swainson's hawk during <br /> construction activities: <br /> • If a nest tree becomes occupied <br /> during construction activities,then <br /> all construction activities shall <br /> remain a distance of two times the <br /> dripline of the tree,as measured <br /> from the nest. <br /> • If the Applicant elects to remove a <br /> nest tree,prior to removal,surveys <br /> of the nest tree shall be conducted <br /> first by a qualified biologist to <br /> confirm the tree is no longer <br /> occupied. These surveys shall <br /> follow the Recommended Timing <br /> and Methodology for Swainson's <br /> Hawk Nesting Surveys in <br /> California's Central Valley <br /> (Swainson's Hawk Technical <br /> Advisory Committee,2000)as <br /> follows: <br /> • January 1 to March 20— <br /> Conduct one(1)survey,all day <br /> • March 20 to April 5—Conduct <br /> three(3)surveys,sunrise to <br /> 10:OOam and 4:OOpm to sunset <br /> • April 5 to April 20— Conduct <br /> three(3)surveys,sunrise to <br /> 12:OOpm and 4:30pm to sunset <br /> • April 21 to June 10-Monitoring <br /> • June 10 to July 30—Conduct <br /> three(3)Surveys,sunrise to <br /> 12:OOnoon and 4:OOpm to <br /> sunset. <br /> Section 1.0 Introduction 12 August 2022 <br />
