• <br /> CLEANUP AND ABATEMENT ORDER NO. 93-712 -9- <br /> NESTLE BEVERAGE COMPANY <br /> SAN JOAQUIN COUNTY <br /> analysis of alternatives using the following criteria: 1) overall protection of human health <br /> and the environment, 2) compliance with State and Federal Regulations, Plans and <br /> Policies, 3) long term effectiveness and permanence, 4) reduction of toxicity, mobility <br /> and volume, 5) short term effectiveness, 6) implementability, 7) cost, 8) state acceptance <br /> and 9) community acceptance. <br /> 11. By no later than 60 days after approval by the Board of the FS Report, prepare and <br /> submit a Proposed Plan for Remedial Action. The Proposed Plan shall recommend one <br /> or a combination of the cleanup remedies which can cleanup ground water and soils to <br /> meet State and Federal regulations identified above. The Proposed Plan shall be <br /> presented to the public and a Public Meeting shall be held to discuss the proposed <br /> remedial action. <br /> 12. By no later than 90 days after the Public Meeting and the receipt of all public comments, <br /> submit a Draft Record of Decision (ROD) for the treatment of contaminated soil and <br /> ground water. The ROD should provide a summary of the site characterization and the <br /> baseline risk assessment and a comparative analysis of treatment alternatives, should <br /> describe the aquifer cleanup levels, effluent performance standards and the technical <br /> aspects of the selected remedy, should provide an estimate of the time needed to <br /> complete remediation and should include the Responsiveness Summary for comments <br /> received during the public comment period. <br /> 13. By no later than 180 days after issuance of the ROD by the Board, submit a 30 percent <br /> Remedial Design (RD) for the selected remedy(ies) for soil and ground water. The 30 <br /> percent design shall specify the implementation of the Board approved remedies and shall <br /> contain a time schedule for the RD. The 30 percent RD must include the following <br /> submittals: Operation and Maintenance Plan, Construction Quality Assurance Plan, Field <br /> Sampling and Soil and Ground Water Monitoring Plan, Health and Safety Plan and a <br /> Remedial Action Work Plan. <br /> 14. By no later than 180 days after approval by the Board of the 30 percent RD, submit the <br /> 95 percent RD. The 95 percent RD must adequately address the Board's concerns with <br /> the 30 percent RD. <br /> 15. By no later than 60 days after approval by the Board of the 95 percent RD, submit a 100 <br /> percent RD for soils and ground water. <br /> 16. In accordance with a schedule to be established in the 100 percent RD, begin <br /> implementation of the Final Remedial Action (RA) for the site. <br />
