Box 60 <br /> Tracy, CA 95378 <br /> CONDITIONAL NO FURTHER ACTION DETERMINATION, FORMER HOLLY SUGAR <br /> FACILITY, HOLLYDRIVE, TRACY, SAN JOAQUIN COUNTY <br /> California Regional Water Quality Control Board, Central Valley Region (Central Valley Water <br /> Board) staff reviewed the 28 February 2009 Fourth Quarter Monitoring Evaluation, Fifth <br /> Consecutive Quarterly Monitoring Evaluation (Report) submitted on your behalf by John <br /> Minney for the former Holly Sugar facility on Holly Drive in Tracy (Site). <br /> The Site is the location of a former sugar beet facility. In November 1990, about 500 to <br /> 800 gallons of No. 6 fuel oil spilled from a 420,000-gallon aboveground storage tank (AGT) in <br /> the northeast corner of the facility. Spreckels emptied the tank in 1997 and no longer <br /> operates it. <br /> The Report summarizes the site remedial history, sensitive receptor survey, and results of the <br /> fate and transport analysis. Spreckels installed 10 soil borings and three monitoring wells at <br /> the Site. Monitoring wells were sampled eight times between July 2005 and October 2008. <br /> The fate and transport analysis showed that concentrations would not migrate offsite. As <br /> described in the enclosed memorandum, the remaining levels of petroleum constituents do not <br /> pose a threat to human health, the environment, or waters of the State. However, to reduce <br /> the potential for future exposure to the remaining concentrations in soil and groundwater, <br /> Spreckels needs to record a deed restriction for the property. <br /> Spreckels has satisfactorily completed Site investigation and remedial action, achieved <br /> applicable remedial action standards and objectives, and a permanent remedy has been <br /> accomplished at the Site. Therefore, no further action is required. This No Further Action <br /> Determination is not effective until after Spreckels (1) submits the necessary documentation of <br /> the destruction of the monitoring wells in accordance with all applicable County and State <br /> requirements and (2) submits proof of recording the enclosed deed restriction. Once proof of <br /> appropriate destruction and recording is been received, Central Valley Water Board staff will <br /> send written confirmation of the effective date of the Determination. <br /> You have six months from the date of this letter to provide the required monitoring well <br /> destruction and deed restriction recording documentation. Failure to provide the required <br /> documentation will void this conditional No Further Action Determination.
