The owner shall enter into an agreement with San Joaquin <br /> County to participate in an Area of Benefit prior to the <br /> approval of the final parcel map for the off-site improve- <br /> ments on Patterson Pass Road, its interchange with I-205, and <br /> the widening of the bridge on Patterson Pass Road over the <br /> Delta-Mendota Canal . The area of benefit fee for each parcel <br /> shall be payable at the time of development of each of the <br /> Parcels, A, B and C, so long as the Board of Supervisors form <br /> such an Area of Benefit . The owner may deposit with the <br /> County the estimated Area of Benefit fees prior to the for- <br /> mation of the Area of Benefit in order to obtain necessary <br /> building permits . The area of benefit fees for the Patterson <br /> Pass Road, I-205 and Patterson Pass Road bridge improvements <br /> shall not exceed $6 , 000 . 00 per acre. <br /> 5 . Concurrently with the development of Parcel A, the owner <br /> shall construct the intersection improvements at Patterson <br /> Pass Road and Schulte Road. <br /> 6 . When development of Parcel C exceeds 75% of its area ( 40 .05 <br /> acres ) or when the average daily traffic (ADT ) exceeds 3000 <br /> on Patterson Pass Road, the Public Works Department shall <br /> determine if the reconstruction of Patterson Pass Road, <br /> excluding bridge widening, from I-580 to I-205 is warranted. <br /> If the County determines that said improvements to Patterson <br /> Pass Road are warranted the developer shall construct said <br /> improvements and become the beneficiary of the Area of <br /> Benefit . <br /> 7 . The County may modify the off-site improvement requirements , <br /> by reducing the scope of required work, should other <br /> development occur fronting Patterson Pass Road or Schulte <br /> Road. <br /> 8 .
