Mr. Robert Garcia . - 2 - • 19 June 2008
accordance with MRP No. R5-2007-0811, which was updated less than a year ago.
4. According to MRP No. R5-2007-0811 and as required by California Business and
Professions Code Sections 6735, 7835, and 7835.1, all reports shall be prepared by a
registered professional or their subordinate and signed by the registered professional.
A registered professional did not sign or stamp the GeoTrans Report. Leprino needs to
ensure that all reports are signed and stamped by a California registered Professional
Geologist or Professional Civil Engineer. Regional Water Board staff reviewed the
California Board for Professional Engineers and Land Surveyors database and it is not
clear whether the Professional Engineer currently signing the reports is a licensed
California Professional Civil Engineer. The sections from the Business and Professions
Code are reprinted below for your reference. By 30 July 2008, Leprino needs to re-
issue the Report with the signature and stamp of the licensed professional overseeing
the work. In addition, all future reports must be appropriately signed.
California Business and Professions Code Section 6735
"All civil (including structural and geotechnical) engineering plans, calculations,
specifications, and reports (hereinafter referred to as "documents") shall be prepared
by, or under the responsible charge of, a registered civil engineer and shall include his
or her name and license number. Interim documents shall include a notation as to the
intended purpose of the document, such as "preliminary," "not for construction," "for
plan check only," or "for review only." All civil engineering plans and specifications that
are permitted or that are to be released for construction shall bear the signature and
seal or stamp of the registrant, the date of signing and sealing or stamping, and the
expiration date of the certificate or authority. All final civil engineering calculations and
reports shall bear the signature and seal or stamp of the registrant, the date of signing
and sealing or stamping, and the expiration date of the certificate or authority."
California Business and Professions Code Section 7835
"All geologic plans, specifications, reports or documents shall be prepared by a
professional geologist, or registered certified specialty geologist, or by a subordinate
employee under his or her direction. In addition, they shall be signed by the
professional geologist, or registered certified specialty geologist or stamped with his or
her seal, either of which shall indicate his or her responsibility for them."
If you have any questions regarding this letter, you may contact Kristi Shelton at (916) 464-
4819 or kshelton(a)waterboards.ca.gov.
L
WENDY L.
