13 . Prior to close of Escrow, Seller shall, at Seller' s <br /> cost and expense, remove all underground storage tanks located at <br /> said Realty, rLemove from said Realty any contaminated soil in <br /> compliance with all governmental regulations , including the <br /> lawful disposal thereof, replace any removed, contaminated soil <br /> with clean soil compacted to a density of 95% of the maximum <br /> density at optimum moisture content as determined by a soils <br /> testing laboratory. It is understood, however, that Seller shall <br /> not be obligated to commence such tank and contaminated soil <br /> removal until such time as Buyer has notified Seller in writing <br /> that all of the Provision 6 conditions above have been satisfied <br /> and Buyer is ready, willing and able to close the Escrow, subject <br /> to compliance by Seller with its herein Provision 13 obligations. <br /> Seller shall provide Buyer with copies of all environmental test <br /> reports together with the certification from a licensed civil <br /> engineer demonstrating to Buyer's satisfaction that said Realty <br /> is free of contamination . Buyer may elect to conduct <br /> environmental tests itself . If Seller fails to cure any <br /> contamination discovered to the satisfaction of Buyer, Buyer or <br /> Seller may cancel this agreement and the Escrow created thereby <br /> and receive back its Provision 5.A. deposit and any other monies <br /> (other than option monies previously paid to Seller) placed into <br /> Escrow or paid to Seller. <br /> 14 . Notices relating to this transaction shall be in <br /> writing and shall be deemed delivered when personally given or <br /> when deposited with the U. S . Postal Service, certified mail . <br /> Notices to Seller shall be sent to: <br /> Jim Duncan <br /> Duncan, Duncan & Associates <br /> 1110 W. Kettleman Lane, Suite 20 <br /> Lodi, CA 95240 <br /> and to buyer at: <br /> Atlantic Richfield Company <br /> 515 South Flower Street <br /> Los Angeles, CA 90071 <br /> Attention: C.H. Schwab <br /> AP 1841 <br /> 15 . This agreement shall also constitute Escrow <br /> instructions. <br />
