. i <br /> Page 9 of 27 <br /> i <br /> Manteca Waste Ordinance : Title 13 Chapter 13.020 of the Manteca Municipal Code <br /> that describes the authorities of the City of Manteca to enforce EPA and local <br /> requirements related to waste discharge to the Manteca water pollution control system. <br /> Manteca Industrial Waste Discharge Permit: A permit stating the conditions, <br /> prohibitions,limits, and requirements for discharges to the Manteca water pollution <br /> control system that is issued to all significant industrial users and any other users that <br /> discharge to the water pollution control system a waste, of substantial volume or of a <br /> concentration, that the Director of Public Works deems significant and therefore requires <br /> a permit. <br /> Member Jurisdiction: Any city or agency, such as the City of Lathrop, which owns and <br /> operates a collection system connected to the City of Manteca water pollution control <br /> system. The relation of a member jurisdiction is specified in an interjurisdictional <br /> agreement. <br /> National Pretreatment Standards: Any regulations containing pollutant discharge <br /> limits promulgated by EPA in accordance with Section 307'(b) and(c)of the Act(33 <br /> U.S.C. 1317) and which apply to.a specific category of industrial users. These <br /> regulations are found at 40 CFR Chapter I,Subchapter N,Parts 405-471. <br /> New Source: Any building, structure, facility,or installation from which there is or may <br /> be a discharge of pollutants, the construction of wluch continences after the publication <br /> of a proposed Pretreatment Standard under section 307 (c)'of the Act which will be <br /> applicable to such source if such standards are thereafter promulgated in accordance with <br /> that section. Specific location and construction criteria for;determining a new source are <br /> as in,40 CFR 403.3 (k). <br /> Noncompliance: Any violation of any part of this Waste Ordinance, the industrial <br /> discharge permit,or National Categorical Standards. <br /> Notice of Violation (NOV): An official communication from the City to the non- <br /> compliant industrial user informing the industrial user that a violation has occurred. <br /> Nuisance: Any nuisance defined by California statutes or known at common law or in <br /> equity jurisprudence. <br /> Pass-Through: A discharge which exits the Manteca's treatment works into the waters <br /> of the State or into Manteca's land disposal system in quantities or concentrations,which <br /> alone or in conjunction with a discharge or discharges fiom other sources,is a cause of a <br /> violation of any requirement of Manteca's NPDES permit or of Manteca's RWQCB <br /> permit, including an increase in the magnitude or duration of a violation. <br /> i <br /> Permittee: The person to whom an Industrial Discharge Permit has been issued pursuant <br /> hereto. <br /> i <br /> Permit No. 05-3 <br /> Cardoza Enterprises <br />
