ORDINANCE NO 1275 <br /> PAGE NO 28 <br /> (c) Record Keeping_Requirement All persons subject to the reporting <br /> requirements of this Waste Ordinance and 40 CFR 403 12 shall maintain records <br /> of all information resulting from any monitoring activities and results, and make <br /> such records available for inspection and copying by EPA officials and Manteca <br /> personnel or agents, for a minimum of 3 years, or a period of litigation whichever <br /> is longer <br /> 13.020.070 - INSPECTION AND MONITORING <br /> (a) Inspection Procedure. Manteca shall inspect the premises of any user <br /> to establish compliance with the provisions of this Waste Ordinance, the riser's <br /> industrial discharge permit, and any applicable California State, Federal, and local <br /> laws pertaining to the treatment and discharge of waste to the water pollution control <br /> system <br /> (1) Inspections shall be made under the provisions of this Waste <br /> Ordinance and/or the user's industrial waste permit If the user refuses <br /> reasonable access to the premises for purposes of inspection and monitoring, <br /> Manteca shall notify the user that he is in violation of this Waste Ordinance <br /> and the Assistant Director of Public Works may issue an Administrative <br /> Order, mandating such access by a specified date and at all reasonable times <br /> subsequent to that date <br /> . (2) An administrative warrant may be obtained in instances where the <br /> Assistant Director of Public Works or his agent believes there is substantial <br /> evidence that user refusal to consent to inspection and/or monitoring is <br /> concealing criminal acts, or willful or negligent discharges in violation of this <br /> Waste Ordinance or any other applicable laws or regulations <br /> (3) Where deemed necessary to protect the water pollution control <br /> system, the environment, or the public health, safety, or welfare from the <br /> effects of present or imminent discharges, the Director of Public Works or his <br /> agent may invoke emergency measures, as described in Section 13 020 90 <br /> (c) of this Waste Ordinance These measures include providing access to a <br /> premise for the Director of Public Works or his agents,without the consent of <br /> the owner or user <br /> (4) Manteca retains the right to enter the premises to inspect the <br /> premises, processes, and records of the user, to sample or monitor the <br /> discharge, and to copy all records relating to pretreatment, chemical and <br /> waste storage, and waste discharge to the Manteca water pollution control <br /> system, pursuant to 40 CFR 403 8 (f) (1) (v), to verify that the waste <br /> discharge is in compliance with industrial discharge permit, with this Waste <br /> Ordinance, and all applicable State, Federal, and local laws pertaining to <br /> pretreatment and waste disposal to POTWs or waters of the United States <br /> S Manteca shall also have the right to install and operate any necessary <br /> sampling and monitoring equipment on the premises of the user, at a fee cost <br /> to the user, to document compliance <br /> 1 <br />
