ORDINANCE NO 1274 <br /> PAGE NO 18 <br /> • are described in the Manteca Pretreatment Program and the Manteca <br /> Pretreatment Program requirements are hereby incorporated as part of <br /> this Waste Ordinance <br /> (3) Permit Limitations <br /> (i) All industrial discharge permits shall be expressly subject to all <br /> provisions of the Waste Ordinance and all rates and charges <br /> established by Manteca All permits shall be issued for a specified <br /> time period, not to exceed five (5) years The Assistant Director of <br /> Public Works may establish renewal dates from one to sixty <br /> months <br /> (u) No vested rights of any type whatsoever of discharge to or <br /> sewerage capacity in the sanitary sewer system is created by the <br /> issuance of an industrial discharge permit <br /> (iii)Each permit is subject to renewal upon request to Manteca <br /> Applications for permit renewal shall be submitted to Manteca by <br /> the deadline stated in the user's waste discharge permit Permit <br /> renewal is not guaranteed and shall be subject to capacity <br /> limitations, treatment requirements, and compliance history <br /> considerations <br /> (iv)The permitted discharge is accepted only on a capacity available <br /> basis Such discharge is subject to reduction, modification, <br /> suspension, or termination at any time by Manteca with a phone <br /> call or written notice Discharge shall cease immediately upon <br /> request by Manteca and shall not be continued without written <br /> permission from Manteca. <br /> (v) Any permit issued pursuant to this Waste Ordinance may be <br /> revoked or suspended at any time by the Director of Public Works <br /> for fraud, misrepresentation, or false statement contained in an <br /> application for permit, or for violation of any condition of permit, or <br /> of any provisions of this Waste Ordinance <br /> (vi)Any permit issued pursuant to this Waste Ordinance may be <br /> modified, at any time, by the Assistant Director of Public Works, <br /> including the term and conditions for industrial discharge, discharge <br /> quantity, and/or concentration limits authorized therein <br /> (4) Permit Transfer The industrial discharge permit is issued only to a <br /> specific person and for a specific location, as designated in the permit, <br /> and shall not be assignable nor transferable to any other person or any <br /> other location Sale or relocation of a business, public agency, or person <br /> shall obligate the business, public agency, or person to obtain written <br /> approval from the Assistant Director of Public Works prior to continuing <br />
