ORDINANCE NO 1275 <br /> PAGE NO 3 <br /> Authorized Representative of the Industrial User: An authorized <br /> representative of an industrial user shall be a principal executive officer of at <br /> least the level of vice president, a general partner or proprietor of the user, or a <br /> duly authorized representative of the person holding the industrial discharge <br /> permit, if such representative is responsible for the overall operation of the <br /> industrial facilities from which the discharge originates The authorized <br /> representative shall be identified on the Industrial Discharge Permit <br /> Categorical User: Any industrial user who, on the basis of the industrial activity <br /> at the facility in question, must comply with National Categorical Standards <br /> Cease and Desist Order An Administrative Order issued by Manteca <br /> requiring a <br /> discharger to halt discharge to the water pollution control system <br /> Chronic Violation A violation of significant noncompliance when sixty six <br /> percent or more of sample measurements exceed the same daily maximum limit <br /> or the same average limit over a six-month period <br /> City: "City' or "Manteca" refers to the City of Manteca <br /> Compliance Order An Administrative Order directing the discharger to <br /> achieve or <br /> restore compliance by a specified date A Compliance Order may include a <br /> compliance schedule with specific milestones for achieving steps toward <br /> compliance, for tracking progress, and for the discharger to report progress <br /> Control Authority. The POTW or the City of Manteca <br /> Director of Public Works Director of Public Works for the City of Manteca or <br /> his agent <br /> Discharger: Any person discharging industrial waste to the water pollution <br /> control system This term specifically includes any categorical users connected <br /> to the water pollution control system, whether or not they discharge process <br /> wastewater It also includes any facilities with a reasonable potential for <br /> discharging significant quantities of industrial waste, whether or not they are <br /> currently discharging process waste <br /> Domestic Waste Any waterborne waste of the type normally resulting from <br /> flushing and washing waste products from residences and lavatories <br /> Federal Pretreatment Regulations: Any regulations promulgated by EPA in <br /> accordance with Sections 307(b) and (c) and 402(b)(8) of the "Act" (33 U S C <br /> 1317) for the implementation, administration, and enforcement of pretreatment <br /> standards <br />
