}Aul-09-97 04:48P STARSKY KIRK LLP 916 567 3967 P.06
' i i
STARSKY & KIRK, LLP
Ms. Margaret Lagorio, Supervisor
July 9, 1997
Page 2
compliance status and the remedial activities that PHS/EHD expects Unocal to undertake. This
makes your refusal to reschedule the meeting all the more perplexing. Mr. Ralston is the Unocal
representative with the most knowledge about the March Lane site and you conceded that
PHS/EHD's directives relative to this site may have been confusing or inconsistent in the past.
Moreover, Mr. Irey indicated to me that this is the site that he is most concerned about at this
time.
Mr. Ralston has confirmed that it is not possible for him to attend a meeting
tomorrow. In Mr.Ralston's absence, and with the relatively short preparation time given us,
Unocal is not in a position to meet with you and Mr. Irey tomorrow. We request that you
reconsider your refusal to reschedule the meeting. Our request for this reasonable
accommodation should not be construed in any way as Unocal's unwillingness and refusal to
comply with the applicable corrective action requirements. To the contrary, our request to
reschedule this meeting so that Mr. Ralston can attend and so that we will be prepared to
participate in a meaningful way should indicate the seriousness with which Unocal takes these
matters.
If you are still not willing to reschedule the meeting, we request that PHS/EHD
set forth in writing those matters that it planned to discuss tomorrow, including specific
directives and, where appropriate, specific references to Title 22, Health and Safety Code, and
local ordinance sections or provisions. It appears that some of the confusion and
misunderstanding on the part of Unocal is due to the broad, general references and directives
given by PHS/EHD. We will contact you after we receive your written directive to discuss and
plan the action to be taken.
Please feel free to call me if you have any questions or would otherwise like to
discuss this.
Very truly yours,
Sherri M. Kirk
of STARSKY & KIRK, LLP
SMK/mws
cc: Ms. Donna Heran, Director, Environmental Health Division
David J. Irey, Esq.
Melissa M. Allain, Esq.
Mr. Ed Ralston
Mr. Bob Boust
