'ermittee shall provide the Department and its representatives access at asonable times to the Facility and any other property to which access is red for implementation of this part of the permit and shall permit such ,ns to inspect and copy all records, files, photographs, documents, ding all sampling and monitoring data, that pertain to work undertaken rant to this part of the permit. b. Tote extent that work being performed pursuant to this part of the permit mus be done on property not owned or controlled by the Permittee, the Perriittee shall use its best efforts to obtain access agreements necessary to com tete work required by this part of the permit from the present owner(s) Of s ch property within 30 days of approval of any workplan for which access is re wired. Best efforts as used in this paragraph shall include, at a minimum, a certified letter from the Permittee to the present owner(s) of such property requesting access agreement(s) to allow the Permittee and the Department and its authorized representatives access to such property and the payment of reasonable sums of money in consideration of granting access. The Permittee shall provide the Department project coordinator with a copy of any access agreement(s). In the event that agreements for access are not obtained within 30 days of approval of any workplan for which access is reqL ired, or of the date that the need for access become known to the Per ittee, the Permittee shall notify the Department in writing within 14 days ther ft the both the efforts undertaken to obtain access and its failure to o tain such agreements. In the event the Department obtains access, the Per ittee shall undertake approved work on such property. C. Not ing in this part of the permit shall be construed to limit or otherwise aff t the Permittee's liability and obligation to perform corrective action incl iding correction action beyond the facility boundary, notwithstanding the lac of access. The Department may determine that additional on-site me4sures must be taken to address releases beyond the facility boundary if access to off-site areas cannot be obtained. 24
