The <br />repro <br />purs <br />persi <br />relat <br />the t <br />mon <br />usln <br />veri <br />The <br />all I <br />reqs <br />incl <br />Draft Hazardous Waste Facility Permit <br />department, its contractors, employees, and/or any USEPA <br />sentatives are authorized to enter and freely move about the facility <br />pant to this part of the permit for the purposes of: interviewing facility <br />nnel and contractors; inspecting records, operating logs, and contracts <br />;d to the Facility; reviewing the progress of the Permittee in carrying out <br />.rms of this part of the permit; conducting such tests, sampling or <br />toring as the Department or its Project Coordinator deems necessary; <br />a camera, sound recording, or other documentary type equipment; and <br />ging the reports and data submitted to the Department by the Permittee. <br />'ermittee shall provide the Department and its representatives access at <br />asonable times to the Facility and any other property to which access is <br />red for implementation of this part of the permit and shall permit such <br />,ns to inspect and copy all records, files, photographs, documents, <br />ding all sampling and monitoring data, that pertain to work undertaken <br />rant to this part of the permit. <br />b. Tote extent that work being performed pursuant to this part of the permit <br />mus be done on property not owned or controlled by the Permittee, the <br />Perriittee shall use its best efforts to obtain access agreements necessary to <br />com tete work required by this part of the permit from the present owner(s) <br />Of s ch property within 30 days of approval of any workplan for which access <br />is re wired. Best efforts as used in this paragraph shall include, at a <br />minimum, a certified letter from the Permittee to the present owner(s) of such <br />property requesting access agreement(s) to allow the Permittee and the <br />Department and its authorized representatives access to such property and the <br />payment of reasonable sums of money in consideration of granting access. <br />The Permittee shall provide the Department project coordinator with a copy of <br />any access agreement(s). In the event that agreements for access are not <br />obtained within 30 days of approval of any workplan for which access is <br />reqL ired, or of the date that the need for access become known to the <br />Per ittee, the Permittee shall notify the Department in writing within 14 days <br />ther ft <br />the <br />both the efforts undertaken to obtain access and its failure <br />to o tain such agreements. In the event the Department obtains access, the <br />Per ittee shall undertake approved work on such property. <br />C. Not ing in this part of the permit shall be construed to limit or otherwise <br />aff t the Permittee's liability and obligation to perform corrective action <br />incl iding correction action beyond the facility boundary, notwithstanding the <br />lac of access. The Department may determine that additional on-site <br />me4sures must be taken to address releases beyond the facility boundary if <br />access to off-site areas cannot be obtained. <br />24 <br />
