Under the law, it does not matter whether the property owner/operator brought the
waste tires on site, allowed others to bring the tires on site or the tires were brought on
site without permission, such as from illegal dumping. In all cases, the property owner
and/or operator are required to remove the tires. If the waste tires are not removed in a
timely manner, further enforcement action will be taken.
Please be advised that if the waste tires are not removed by July 15, 2003, a
Clean-up & Abatement Order setting deadlines and penalties may be issued. To
avoid this action, please advise us prior to July 15, 2003 of when the tires have been
removed and furnish us with copies of all manifests used for the transport of the tires.
Should you have any questions regarding this letter, please call me at (916) 341-6428.
Sincerely,
Stephen PottnPer, IWMS
Waste Tire Management Branch
Special Waste Division
cc: San Joaquin County, Environmental Health
City of Stockton Fire Department
