the storage of waste tires due to improper racking or stacking. Robert McClellon showed <br /> Mr. Montijo the improperly stored tires. Mr. Montijo seemed to be irritated by the <br /> discussion. Robert McClellon explained that those are the minor issues that are at the <br /> site. Robert McClellon went on to explain that there were issues regarding the <br /> transportation of used and waste tires with out the use of a registered hauler or the CTL's. <br /> Mr. Montijo indicated that he had been fined for that although he stated that he had not <br /> paid the fine. Mr. Montijo said that it was a bunch of crap that he could not haul his own <br /> tires in his own truck to his own facility. Mr. Montijo stated that it was not like he was <br /> taking them out and dumping them somewhere. Robert McClellon tried to explain that <br /> he needed to maintain records showing where the tires are being taken so that he can <br /> show that he is properly handling his tires. <br /> The inspection continued to the west side of the tire facility. The area that the drums <br /> were stored was now cleared of drums and debris. The dumpster had been moved. <br /> Robert McClellon took a trash hook and began to searched the inside of the dumpster. <br /> Inspection of the dumpster revealed that there were three jugs that contained a liquid <br /> substance (two 1 gallon anti-freeze jugs D-1, D3 and one 2 gallon liquid soap container <br /> D2). The dumpster also contained oil contaminated floor sweep and a plastic bag of <br /> waste oil soaked cartons and paper debris. Garrett Backus of the EHD took pictures of <br /> the dumpster showing the jugs and other waste oil contaminated debris. <br /> Mr. Montijo indicated that he had taken some oil to a friends business so that it cloud be <br /> picked up. He stated that he friend had got in trouble for taking the waste oil. Robert <br /> McClellon asked Mr. Montijo if he had an EPA number for the site. Mr. Montijo <br /> indicated that he did not. Robert McClellon asked Mr. Montijo if he did oil changes at the <br /> facility Mr. Montijo indicated that he did not. Robert McClellon asked if Mr. Montijo <br /> serviced his own business vehicles. Mr. Montijo indicated that he did not. <br /> Robert McClellon asked how did the oil get to the facility. He stated that he did not <br /> know. May be his brother brought it there. Robert McClellon stated that the waste oil <br /> had water in it. Mr. Montijo indicated that that is why he thought it was ok to put it in the <br /> dumpster. Robert McClellon asked why? Mr. Montijo indicated that because it comes <br /> from the ground. Robert McClellon questioned Mr. Montijo, the oil? Mr. Montijo said <br /> yes. Mr. Montijo went on to complain about the requirements for waste tire hauling and <br /> was not happy about the fine he received. <br /> Robert McClellon removed the jugs from the dumpster and removed the caps. Two of <br /> the jugs had a strong odor of old gasoline (D-1 and D2). The third container (D-3) <br /> appeared to contain waste oil and water. Robert McClellon went to the vehicle and <br /> retrieved sample jars and Proper Protective Equipment (PPE). Robert McClellon poured <br /> the liquid from the jug into sample jars. The jars were properly labeled (D-1, D-2, D-3) <br /> and photographed by Garrett Backus of the EHD. <br /> The samples were in Robert McClellon's custody during the remainder of the inspection <br /> and then placed in a secured locker at the EHD storage locker on the Second Floor.
