Paul Franzia • - 2 - • 1 May 2007 <br /> On 25 August 2006 a Response to Conditional Approval, prepared by Kennedy/Jenks <br /> Consultants, was submitted addressing the Regional Water Board's Conditional Approval. <br /> Barrel Ten is seriously out of compliance with the CDO requirement for submittal of an RWD <br /> by 1 February 2005 that describes groundwater quality and documents facility improvements <br /> that are protective of groundwater quality. It is unclear how the RWDs submitted to date were <br /> developed to provide adequate source control and wastewater treatment to protect <br /> groundwater quality if, even at this late date, the groundwater quality is not adequately <br /> characterized. <br /> By 31 May 2007 Barrel Ten shall submit all the groundwater quality data (including that <br /> collected from groundwater monitoring wells and other facility wells) collected at the site since <br /> 1 January 2000. The data shall be provided in an electronic format compatible with Excel and <br /> shall be organized in a way that allows convenient review of the data. in addition, by 3 i May <br /> 2007, Barrel Ten shall submit a Groundwater Characterization Report that presents Barrel <br /> Ten's current understanding of groundwater conditions and the impact of on- and off-site <br /> waste discharge. <br /> Failure to submit the data, or submittal of incomplete data or reports may result in additional <br /> enforcement activities.
