CERCLA/SARA Section 101(9), 42 U.S.C. 9601(9), and RCRA Section 3004, 42 <br /> U.S.C. 6924, and is a "Site" within the meaning of California Health and <br /> Safety Code Section 25356. <br /> 4.2.2 "Hazardous substances" as defined in Section 101(14) of <br /> CERCLA/SARA, 42 U.S.C. 9601(14), were deposited, stored, disposed of, <br /> placed, or otherwise came to be located at the Depot. <br /> 4.2.3 "Hazardous wastes" as defined in Section 25316 of the California <br /> Health and Safety Code were released at the Depot, and discharged into <br /> "waters of the state", as that term is defined by Section 13050 of the <br /> California Water Code. <br /> 4.2.4 There have been releases and there continue to be releases and <br /> threatened releases of hazardous substances into the environment within the <br /> meaning of CERCLA/SARA Sections 101(22), 104, 106, and 107, 42 U.S.C. <br /> 9601(22), 9604, 9606, and 9607, and California Health and Safety Code <br /> Section 25320. <br /> 4.2.5 With respect to releases described in Subsection 4.2.3 above, <br /> SHAD is a person within the meaning of CERCLA/SARA Section 107, 42 U.S.C. <br /> 9607, California Health and Safety Code Section 25319, and California Water <br /> Code Section 13050. <br /> 4.2.6 The Department of the Army is the owner of Sharpe Army Depot. <br /> 4.2.7 Sharpe Army Depot constitutes a Federal Facility within the <br /> meaning of Section 120 of CERCLA/SARA, 42 U.S.C. 9620. <br /> 4.2.8 SHAD has commenced two (2) removal actions on the Site: the <br /> South Balloon Treatment System and the North Balloon Treatment System. No <br /> additional removal actions are anticipated prior to the Record of Decision <br /> (ROD). <br /> -11- <br />
