5.3 COMPLIANCE APPROACH <br /> 5.3.1 APPLICABILITY <br /> This SPCC Plan is effective upon approval of the Chief Operator of this facility which is <br /> the A.L.Powell Trucking main office location at 5901 Marina Rd., Ste 1 ; Discovery <br /> Bay, CA 94505. <br /> This SPCC Plan applied to the management of all oil-containing aboveground storage <br /> tanks, drums, equipment, and other containers owned or leased by A.L.Powell <br /> Trucking that have a capacity of 55 gallons or more. <br /> Since A.L.Powell Trucking conducts the operation and maintenance of oil storage <br /> vessels, it is responsible for operations and maintenance and accountable for spill <br /> prevention for that facility per 40 CFR 112.7 (f)(2). <br /> The Chief Operator is the designated individual responsible for the general <br /> management of the oil spill prevention program on this facility. <br /> 5.4 GENERAL MANAGEMENT GUIDELINES <br /> The management of bulk oil storage tanks, oil-containing equipment, and all other <br /> petroleum containers must ensure compliance with federal and California regulatory <br /> requirements as summarized in Section 2.3 of this SPCC Plan. <br /> The office responsible for ensuring that an oil storage tank subject to the provisions of <br /> 40 CFR 112, Oil Pollution Prevention, is managed, configured, and equipped in <br /> accordance with this SPCC Plan will be that office so designated in Table 4-1 , Inventory <br /> of Aboveground Oil Tanks. <br /> Each oil storage tank on the A.L.Powell Trucking facility must be specifically assigned <br /> to the A.L.Powell Trucking manager that will be responsible for ensuring the tank <br /> complies with applicable requirements of 40 CFR 112 and this SPCC Plan. Normally, <br /> the responsible office will be that office that maintains, replenishes, and operates the <br /> storage tank. If tank compliance with this SPCC Plan is effected through a contractor, <br /> the office that awarded the contract must ensure that contractual mechanisms are in <br /> place so that compliance status can be routinely and regularly verified. It is important to <br /> remember that responsibilities required by law or regulation cannot be changed by <br /> contract and that A.L.Powell Trucking may be liable for an operator's or contractor's <br /> failure to comply with applicable laws and regulations. <br /> If a responsible office cannot be determined for a particular oil storage tank then <br /> A.L.Powell Trucking will assume responsibility for the tank and will initiate closure <br /> actions in accordance with applicable federal and California regulations if necessary. <br /> Any oil storage tank or item of oil-containing equipment that is found to be leaking will <br /> be immediately removed from service pending repair or replacement by the responsible <br /> 60 <br />
