FACILITY MAPS <br /> INTRODUCTION <br /> The National Oil and Hazar ous Substances Pollution Contingency Plan,as well as federal <br /> regulations in 40 CFR, Part 12,state that the person responsible for the discharge of oil or <br /> hazardous materials should ke appropriate action for containment and recovery of such <br /> material. Cleanup activities ill be evaluated by an agency of the federal government. If <br /> cleanup is judged inadequat ,the agency will direct further operations,with the responsible <br /> parry to be liable for the res sting costs. <br /> Union Pacific Railroad(UP )has the responsibility and authority to initiate and direct <br /> response activities for the c trol of spills originating within facility boundaries. Specifically, <br /> UPRR will assume such res onsibility for spills related to on-site operation, filling, and <br /> maintenance of the operatin equipment for this facility. <br /> Pursuant to Section 112 of itle 40 of the Code of Federal Regulations [40 CFR 1121,a <br /> facility that manages oil abo le specified levels and which has the potential for a release to enter <br /> a navigable water(without c nsideration of any secondary containment that may be provided) <br /> shall prepare a Spill Prevent on,Control and Countermeasure(SPCC) Plan(Plan).A Plan is <br /> not required if(1)the under ound buried storage capacity of the facility is 42,000 gallons or <br /> less of oil, and(2)the storag capacity,which is not buried,at the facility is 1,320 gallons or <br /> less of oil, provided no singl container has a capacity in excess of 660 gallons, and(3)due to <br /> its location,the facility couh not reasonably be expected to discharge oil into navigable <br /> waters. <br /> This Spill Prevention,Control and Countermeasure(SPCC)plan(Plan)has been prepared in <br />
