' Engineer is assured of the cooperation. and assistance of both <br /> the Contractor and the material producer. The Engineer or his <br /> authorized representative shall have free entry at all times to <br /> ' such parts of the plant as concerns the manufacture or <br /> production of the materials. Denial of such entry will result <br /> in rejection for use of the material or product involved. <br /> The Agency assumes no obligation to inspect materials at the <br /> source of supply . The responsibility of incorporating <br /> ' satisfactory materials in the work rests entirely with the <br /> Contractor, notwithstanding any prior inspections or tests. <br /> G5. 10 Materials or Equipment Specified by Name. When any material <br /> ' <br /> or equipment is indicated or specified by patent or proprietary <br /> name or by the name and catalogue number of the manufacturer , <br /> it shall be considered as used for convenience in describing <br /> the material or equipment desired. It is not the intent to <br /> eliminate other equipment and materials equally as good and <br /> efficient. Request for substitution of such alternative <br /> materials and equipment shall be made in writing by the <br /> ' Contractor in ample time to permit approval without delaying <br /> the work . However , no item of equipment will be considered <br /> which is not the standard product of a recognized manufacturer <br /> ' regularly engaged in the manufacture of such equipment, and <br /> which does not have a record of at least five ( 5) years of <br /> successful operating experience under comparable service <br /> conditions . A list of representative installations shall be <br /> furnished if requested by the Engineer. Until and unless such <br /> substitutions are approved by the Engineer , no deviations from <br /> the specifications shall be allowed. <br /> ' The burden of proof as to the quality and suitability of the <br /> alternative shall be upon the Contractor, and his request shall <br /> be accomplished by complete details or information necessary to <br /> determine such quality or suitability. The Engineer shall be <br /> the sole judge as to the quality and suitability of alternative <br /> materials or equipment, and his decision shall be final. <br /> ' G5.11 Property Rights in Materials. Nothing in this contract shall <br /> be construed as vesting in the Contrator any right of property <br /> ' in the materials used after they have been installed , attached <br /> or affixed to the work , and cannot be removed from the work <br /> without the consent of the Engineer. <br /> ' G5. 12 Contractor Is_Eguipment. The Contractor shall provide <br /> adequate and suitable equipment and means of construction to <br /> meet all the requirements of the work , including completion <br /> ' within the time allotted . Only equipment suitable to produce <br /> the quality of work required will be permitted to operate on <br /> the subject. The Contractor alone shall be responsible for the <br /> safety, adequacy, and efficiency of his plant, equipment, and <br /> ' methods. <br /> ' G-19 <br /> 1 <br />
