1 <br /> The Engineer may , at his option , permit the use of new or 1 <br /> improved equipment . If such permission is granted , it is <br /> understood that it is granted for the purpose of testing the 1 <br /> quality and continuous attainment of work produced by the <br /> equipment, and the Engineer shall have the right to withdraw <br /> such permission at any time that he determines that the 1 <br /> alternative equipment is not producing work that is equal in <br /> all respects to that specified, or will not complete the work <br /> in the time specified. <br /> In any case where the use of a particular type or piece of 1 <br /> equipment has been banned or in cases where the Engineer has <br /> condemned for use on the work any piece or pieces of equipment, 1 <br /> the Contractor shall promptly remove such equipment from the <br /> site of the work . Failure to do so within a reasonable time <br /> shall be evidence of a breach of contract. <br /> G5.13 Dismissal of Unsatisfactory_Emp 2yYt2s . If any person 1 <br /> employed by the Contractor or any subcontractor shall fail or <br /> refuse to carry out the directions of the Engineer , or is , in 1 <br /> the opinion of the Engineer , incompetent , unfaithful , <br /> intemperate , or disorderly ; or uses threatening or abusive <br /> language to any person on the work representing the Agency; or 1 <br /> is otherwise unsatisfactory, he shall be removed from the job <br /> site immediately, and shall not again be employed on the work <br /> except with the consent of the Engineer . <br /> G_5_ . 14 Termination of Unsatisfactory Subcontracts. When any portion 1 <br /> of the work which has been subcontracted by the Contractor is <br /> not being prosecuted in a satisfactory manner , the 1 <br /> subcontractor for such work shall be removed from the job site <br /> immediately by the Contractor upon written notice from the <br /> Engineer , and the subcontractor shall not again be employed on 1 <br /> the type of work in which his performance was unsatisfactory. <br /> G5. 15 Temporary Suspension of Work . The Engineer shall have the <br /> authority to suspended the work wholly or in part , for such 1 <br /> period as he may deem necessary, due to unsuitable weather or <br /> to any other conditions he considers unfavorable for the <br /> suitable prosecution of the work ; or for such time as may be 1 <br /> necessary due to the failure on the part of the Contractor to <br /> carry out orders given or to perform any provisions of the <br /> contract . The Contractor shall immediately comply with such <br /> written order of the Engineer to suspend the work wholly or in 1 <br /> part. The suspended work shall be resumed only when conditions <br /> are favorable or methods are corrected, as ordered or approved <br /> in writing by the Engineer. 1 <br /> If the Engineer orders a suspension of the work which is the <br /> current controlling operation or operations due to unsuitable <br /> weather or to other conditions which are considered unfavorable 1 <br /> G-20 1 <br /> 1 <br />
