otherwise. ' If the work is completed as provided above, the Contractor is not entitled to receive any portion of the amount to be paid ' under the contract until it is fully completed . After completion, if the unpaid balance exceeds the sum of the amount expended by the Agency in finishing the work, plus all damages sustained or to be sustained by the Agency plus any unpaid claims on account of labor , materials , tools, equipment, or supplies contracted for by the Contractor for the work herein ' contemplated , provided that sworn statements of said claims shall have been filed with the Agency, the excess not otherwise required by these specifications to be retained shall be paid the Contractor . If the sums so expended exceed the unpaid ' balance, the Contractor and his surety are liable to the Agency for the amount of such excess . If the surety completes the contract work as provided above , such surety shall be subrogated to money due under the contract and to money which shall become due in the course of completion of the surety. G5.17 Suspension of Work Because of Conditions Beyond Control of ' Agency_ or Contractor . Should the work of this contract be suspended for a period of over one ( 1) year due to war conditions , labor conditions, legal actions, or for any other ' reason beyond the control of either the Agency or the Contractor , the work may be terminated by mutual agreement subject to the following conditions . The Agency shall be ' responsible for payment for the actual work accomplished only, based on bid prices. The pro-rated cast of such work , where not fully covered by unit costs or bid items , shall be determined by the Agency, using as a basis the complete breakdown of the ' contract price as required by G7. 03. 6. LEGAL RELATIONS AND RESPONSIBILITY ' G6. 01 Compliance with Laws and Regulations . The Contractor shall keep himself fully informed of and shall observe and comply with , and shall cause any and all persons , firms , or corporations employed by him or under him to observe and comply ' with , all State and national laws and County and municipal ordinances , regulations , orders , and decrees which in any manner affect those engaged or employed on the work, or the materials used in the work , or which in any way affect the conduct of the work . Particular attention is called to the following: a. Hours of Labor Eight (8) hours of labor shall constitute a legal day ' s work , and the Contractor or any subcontractor under him , in the execution of the contract , shall not require more than eight (8) hours of G-22
