rhe first obtains written permisison from the Engineer. Such <br /> permission may be revoked by the Engineer at any time if the <br /> Contractor fails to maintain adequate force and equipment for <br /> reasonable prosecution and to justify inspection of the work , <br /> or fails to provide sufficient artificial light to permit <br /> proper inspection. <br /> The Contractor shall give the Engineer 24 hours prior notice <br /> of any work to be done on a Saturday, with the location and <br /> type of work to be done specified ; and any work done without <br /> such notice and without the supervision of an inspector may be <br /> ordered removed and replaced at the Contractor ' s expense. <br /> All costs of overtime inspection, except those occurring as a <br /> result of overtime and shift work established as a regular <br /> procedure , may be charged to the Contractor . Overtime <br /> inspection shall include inspection required during holidays , <br /> Saturdays, Sundays, and any weekday between the hours 6 :00 p.m. <br /> and 7 : 00 a.m. Such costs will include but will not necessarily <br /> I be limited to engineering, inspection, general supervision, and <br /> other overhead expenses which are directly chargeable to the <br /> overtime work. All such charges shall be deducted by the Agency <br /> from payments due the Contractor. <br /> Overtime work shall not entitle the Contractor to any <br /> compensation for any contract item in addition to that <br /> stipulated in the contract for the kind of work performed. In <br /> case of extra work ordered by the Engineer , no additional <br /> payment will be made to the Contractor because of the payment <br /> by him of overtime wage rates for such work, unless the use of <br /> overtime work in connection with such extra work is <br /> specifically ordered in writing by the Engineer, and then only <br /> to such extent as extra payment is regularly being made by the <br /> Contractor to his personnel for overtime work of a similar <br /> nature in the same locality. <br /> ' G7. 12 Removal of Rejected Materials or Work. The Contractor shall, <br /> without delay, remove from the site of the work all rejected or <br /> condemned materials of any kind brought to or incorporated in <br /> the work. No such rejected or condemned materials shall again <br /> be offered for use in any work under this contract. All work <br /> which has been rejected shall be remedied , or removed and <br /> replaced by the Contractor in an acceptable manner at his <br /> expense. <br /> Upon failure of the Contractor to comply within a reasonable <br /> time with any written order of the Engineer made under this <br /> paragraph, or to make satisfactory progress in so doing , the <br /> Agency may cause such rejected materials to be removed, or such <br /> rejected work to be remedied , or removed and replaced, and <br /> deduct and retain the costs from any sums due or to become due <br /> the Contractor . <br /> G-35 <br />
