tbe those caused by acts or neglect of the Agency or its <br /> employees or those under it by contract or otherwise; by acts <br /> of God or of the public enemy , fire , floods , epidemics , <br /> strikes , or unseasonable weather . Typical weather that can be <br /> expected within the area is not considered an unavoidable <br /> delay. <br /> Delays in the prosecution of parts of the work which may in <br /> themselves be unavoidable but do not necessarily prevent or <br /> delay the prosecution of other parts of the work nor the <br /> completion of the whole work within the time specified will not <br /> be considered as unavoidable delays within the meaning of the <br /> contract. <br /> G7. 17 Notice of Delays. Whenever the Contractor foresees any delay <br /> in the prosecution of the work , and in any event immediately <br /> ' upon the occurrence of any delay which he regards as an <br /> unavoidable delay, the Contractor shall notify the Engineer in <br /> writing of the probability of the occurrence of such delay and <br /> its cause, in order that the Engineer may take immediate steps <br /> to prevent, if possible, the occurrence or continuance of the <br /> delay, and may determine whether the delay is to be considered <br /> avoidable or unavoidable , how long it continues , and to what <br /> extent the prosecution and completion of the work is to be <br /> delayed thereby. <br /> After the completion of any part or the whole of the work , <br /> the Engineer , in estimating the amount of time due the <br /> Contractor , will assume that any and all delays which have <br /> occurred have been avoidable delays , except such delays as <br /> shall have been called to the attention of the Engineer at the <br /> time of their occurrence and found by him to have been <br /> unavoidable. The Contractor will make no claims that any delay <br /> not called to the attention of the Engineer at the time of its <br /> occurrence has been an unavoidable delay. <br /> G7. 18 Extension of Time . The Contractor shall be allowed an <br /> extension of time in which to complete the work equal to the <br /> sum of all unavoidable delays , as determined above, plus any <br /> adjustments of contract time due to contract change orders. <br /> During such extension of time, no liquidated damages or costs <br /> for extra engineering and inspection shall be charged to the <br /> Contractor . Applications for an extension of time must be made <br /> in writing before the expiration of the original time fixed in <br /> the contract , or of the time granted by extension, as the case <br /> may be. <br /> 1 G7 . 19_Cleaning_12p. Throughout the construction period , the <br /> Contractor shall keep the site of the work in a presentable <br /> condition, shall dispose of any surplus materials, clean out <br /> drainage ditches and structures, and repair any fences or other <br /> property damaged during the progress of the work , to the <br /> G-37 <br />
