3. Although the Proposed Regulation VIII has not been approved yet by the San <br /> Joaquin County APCD, once adopted, the applicant shall conform to the <br /> requirements specified within it to assure that appropriate steps have been taken <br /> to control dust. The proposed requirements include demonstrating at least an <br /> overall average 75 percent reduction from uncontrolled PM-10 emissions, <br /> preparing a dust control plan to be approved by the APCD, performing surface <br /> surveys for moisture analysis, and performing visible emission tests or <br /> evaluations. <br /> The applicant shall maintain proper records of the dust control plan which shall <br /> be available for scheduled and unscheduled inspection by the County and the <br /> APCD. <br /> 4. To minimize emissions from the loaders and other equipment used on site, low- <br /> sulfur fuel should be used, and the equipment should have routine maintenance <br /> and tuning performed biweekly. <br /> Noise <br /> 1. The loader, haul trucks, and any other heavy equipment shall be fitted with <br /> state-of-the-art noise shielding and muffling devices. Such devices may reduce <br /> noise from individual pieces of machinery by up to 10 dBA over noise without <br /> noise abatement devices (U.S. Environmental Protection Agency, 1971). <br /> 2. Noise generating activities shall be avoided between 7 p.m. and 7 a.m. when they <br /> would be most disruptive. Excavation activities shall be prohibited during <br /> weekends and holidays, except in emergency situations such as natural disasters. <br /> 3. Noise level monitoring should be conducted at the nearest residences when <br /> extraction activities approach approximately 300 feet of the bluff. Noise <br /> monitoring shall be conducted in accordance with the County Noise Ordinance <br /> (Chapter 16, Section 9-3800). If monitoring indicates that noise levels exceed 65 <br /> db Ldn at the property line, then further noise mitigation should be <br /> implemented. This could include not allowing any extraction activity beyond the <br /> point at which the noise effects occur. Mitigation shall also be required if noise <br /> monitoring indicates an increase of approximately seven dBA or more over <br /> ambient levels at the nearest residence and the resident complains about noise <br /> levels. <br /> Public Facilities <br /> No impacts to Public Facilities would be anticipated from the proposed activity. <br /> As such, no mitigation measures would be required. <br /> Land Use <br /> Use of proposed site for resource extraction would be a long term use that <br /> would, without mitigation, be incompatible with the existing residential and commercial <br /> uses, and residentially zoned areas within the town of Clements, due to noise and visual <br /> impacts. These impacts could be mitigated to less than significant levels by <br />
