The written response was due on 2/7/2016 and was not received by the EHD until 3/21/2016. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San <br /> Joaquin County Environmental Health Department, requires response within 30 days. <br /> CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department. <br /> This is a repeat violation, Class II. <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION:The following open hazardous waste storage containers were observed on-site: <br /> -One black metal 55 gallon drum of used paper filters was observed under the filter crusher open and without a lid. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
