TECHNICAL REPORTING ORD • -5- <br /> RANCH MARKET UST SITE <br /> SAN JOAQUIN COUNTY <br /> (c)Any person discharging hazardous waste, as defined in Section 25117 of the Health and <br /> Safety Code, who knowingly fails or refuses to furnish technical or monitoring program reports as <br /> required by subdivision (b) of Section 13267, or who knowingly falsifies any information provided <br /> in those technical or monitoring program reports, is guilty of a misdemeanor, may be civilly liable <br /> in accordance with subdivision (d), and is subject to criminal penalties pursuant to subdivision (e). <br /> (d)(1) Civil liability may be administratively imposed by a regional board ... for a violation of <br /> subdivision (c) in an amount which shall not exceed five thousand dollars ($5,000)for each day in <br /> which the violation occurs. <br /> Failure to submit the required report to the Central Valley Water B6?rd to the schedule <br /> detailed herein may result in enforcement action(s) being taken against you, which may include <br /> the imposition of administrative civil liability pursuant to Water Code section 13268. Administrative <br /> civil liability of up to $5,000 per violation per day may be ,mposed by tNStorage <br /> y Water <br /> Board for non-compliance with the directives containeerein. <br /> 21. By 28 February 2013, submit a Site Ma a SMP) to t' "Central Valley Water Board. <br /> The SMP is to include a project managem t sch as aunt Chart) showing all major <br /> tasks (including the items ted above) req reds comp environmental work at the Site. <br /> Include adequate time forWal <br /> ractor scheduling, permitting, fieldwork, report preparation, <br /> regulatory review. etc. Discucurrent andifuture uses of the property. Consider that <br /> properties maybe subject touse covenants or deed restrictions if remaining contaminants do <br /> not allow for unrestricted use. <br /> 2. Submit either the MIP Report, or a Work Plan.,'no later than 28 February 2013 that proposes <br /> sufficient work including the installation of soil borings and groundwater monitoring wells, to <br /> delineate the lateral and vertical extent of petroleum hydrocarbons in soil and groundwater <br /> beneath the Site, determine the mass,of petroleum hydrocarbons remaining in soil and <br /> groundwater beneath site, and evaluate appropriate remedial alternatives. This Work Plan is to <br /> include a detailed schedule;with specific dates for initiation of field work, completion of field work, <br /> and submittal of the report of results of the conducted investigation work. <br /> 3. Submit Quarterly Grou 'd, ter Monitoring Reports, both paper copies to the Central Valley <br /> Water Board office,,,§ ectronic copies to the State Water Resources Control Board's <br /> GeoTracker datab'1se (see Reporting Section below), after groundwater monitoring wells are <br /> installed. The first-Quarterly Groundwater Monitoring Report, for the 1 st Quarter 2013, is due <br /> 30 April 2013. <br /> REPORTING <br /> 4. When reporting data, the Dischargers shall arrange the information in tabular form so that the <br /> date, the constituents, and the concentrations are readily discernible. The data shall be <br /> summarized in such a manner as to illustrate clearly the compliance with this Order. <br />
