4.1.5 Non-Payment for Rejected Well <br /> No payment will be made for any labor or materials involved in the <br /> construction of any well, including the reamed enlargement of a test borehole <br /> when such a hole fails to reach the specified or directed final depth and/or <br /> diameter for any preventable cause, or when such a well fails to meet these <br /> specifications. Such holes will be rejected and shall be replaced as specified <br /> below. Preventable failures include any failure caused by faulty or inadequate <br /> drilling equipment, failure caused by negligence or improper drilling operations <br /> or techniques, materials, or failure caused by improperly protecting drill holes and <br /> drilling work from the natural elements, including cave-in resulting from existing <br /> soil conditions. <br /> No payments will be made for any work or material involved in the drilling <br /> of well holes when such well holes fail to meet requirements for plumbness or <br /> alignment. <br /> A rejected well hole shall be abandoned at no additional cost. Any rejected <br /> well shall be supplemented by another well adjacent to the first, at a location <br /> directed by the supervising geologist. <br /> 21 <br />
