Lead-contaminated soils still exist in these <br /> areas at concentrations above the 220 mg/kg cleanup level set by the Department of Toxic Substances <br /> Control (DTSC) for public health protection in residential areas. However, the majority of the confirmation <br /> samples are below 220 mg/kg. <br /> I have discussed the matter with Mr. Eric Garcia of the DTSC. Mr. Garcia is unable to give specific <br /> guidance unless Southern Pacific signs a voluntary cleanup agreement with DTSC to determine a site <br /> specific cleanup level higher than 220 mg/kg for those areas. However, my review of the situation shows <br /> that further excavation is not feasible, lead concentrations do not greatly exceed the conservative preliminary <br /> cleanup level, and the specific areas with lead above 220 mg/kg are not going to be sold for future <br /> residential development. Therefore, you may proceed with backfilling the excavations with clean fill. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability for <br /> any conditions or claims arising as a result of past, current or future operations at this location. Nothing in <br /> this determination is intended or shall be construed to limit or preclude the Board or any other agency from <br /> taking any further enforcement actions. This letter does not relieve Southern Pacific Transportation <br /> Company of any responsibilities mandated under the California Health and Safety Code.and the California <br /> Water Code if existing, additional, or previously-unidentified contamination at the site causes or threatens to <br /> cause pollution or nuisance or is found to pose a threat to public health or water quality.
