Lead-contaminated soils still exist in these
areas at concentrations above the 220 mg/kg cleanup level set by the Department of Toxic Substances
Control (DTSC) for public health protection in residential areas. However, the majority of the confirmation
samples are below 220 mg/kg.
I have discussed the matter with Mr. Eric Garcia of the DTSC. Mr. Garcia is unable to give specific
guidance unless Southern Pacific signs a voluntary cleanup agreement with DTSC to determine a site
specific cleanup level higher than 220 mg/kg for those areas. However, my review of the situation shows
that further excavation is not feasible, lead concentrations do not greatly exceed the conservative preliminary
cleanup level, and the specific areas with lead above 220 mg/kg are not going to be sold for future
residential development. Therefore, you may proceed with backfilling the excavations with clean fill.
Nothing in this determination shall constitute or be construed as a satisfaction or release from liability for
any conditions or claims arising as a result of past, current or future operations at this location. This letter does not relieve Southern Pacific Transportation
Company of any responsibilities mandated under the California Health and Safety Code.and the California
Water Code if existing, additional, or previously-unidentified contamination at the site causes or threatens to
cause pollution or nuisance or is found to pose a threat to public health or water quality.
