Studley Company <br /> 17950 Via Nicolo 17950 Via Nicolo <br /> Tracy, California 95376 Tracy, CA 95376 <br /> NOTICE OF VIOLATION, 3rd QUARTER MONITORING REPORT, SURFACE <br /> IMPOUNDMENTS, MUSCO OLIVE PRODUCTS INC., SAN JOA QUIN COUNTY(Case File <br /> #2743) <br /> We have completed the review of the 3rd Quarter 2001 Monitoring Report for the Class II Surface <br /> Impoundments. This monitoring is required by Waste Discharge Requirements Order No. 96-075 <br /> (WDRs) and associated Standard Provisions and Reporting Requirements, 1 September 1993. The <br /> surface impoundments are regulated under Title 27, California Code of Regulations (Title 27), Division <br /> 2, Subdivision 1. Based on our review of the minimum standards, we find the Discharger is in violation <br /> due to; (1) the 3`1 Quarter report is incomplete; and (2)has been found inadequate with regards to the <br /> detection monitoring program. <br /> We are concerned that the current groundwater monitoring system has not yielded enough water for <br /> sampling for an extended period of time. Title 27, §20415(b)(1)(B) requires a Detection Monitoring <br /> Program include: <br /> (B) For DMP—for a detection monitoring program under§20420: <br /> 1. a sufficient number of Monitoring Points(as defined in§20164) installed at appropriate <br /> locations and depths to yield ground water samples from the uppermost aquifer that represent <br /> the quality of ground water passing the Point of Compliance and to allow for the detection of a <br /> release from the Unit; <br /> 2. a sufficient number of Monitoring Points installed at additional locations and depths to yield <br /> ground water samples from the uppermost aquifer to provide the best assurance of the earliest <br /> possible detection of a release from the Unit; <br /> 3. a sufficient number of Monitoring Points and Background Monitoring Points installed at <br /> appropriate locations and depths to yield ground water samples from portions of the zone of <br /> saturation, including other aquifers,not monitored pursuant to&(b)(1)(B)1. and&(b)(1)(B)2.,to <br /> provide the best assurance of the earliest possible detection of a release from the Unit; <br /> 4. a sufficient number of Monitoring Points and Background Monitoring Points installed at <br /> appropriate locations and depths to yield ground water samples from zones of perched water to <br /> provide the best assurance of the earliest possible detection of a release from the Unit; and <br /> 5.
