Photos of the repainted tank are provided in Appendix A. <br />2.6 Spill Prevention or Overfill Eauipment 122 CCR & 66265.191(e)(6)1 <br />As discussed in Section 2.2, the used oil enters the tank through a metal storage container with a <br />shelf on which the used oil filters sit and drain oil through a funnel into the tank. Because the funnel <br />is in direct contact with the tank, there is no pathway for the used oil to spill out of the tank. A <br />dipstick is used to measure the level of oil in the tank. The tank is routinely monitored. <br />In addition, the tank is located in the petroleum product storage area, which is a fully contained <br />concrete walled basin and provides secondary containment for the tank. The dimensions ofthe basin <br />are 39 -feet by 39 -feet and the wall is 2 -ft high. The total containment volume is 3042 square feet or <br />approximately 22,800 gallons. This secondary containment volume far exceeds the capacity of the <br />250 gallon tank. <br />The concrete basin is constructed of materials that are compatible with the used oil. The basin is <br />sloped to drain to the west with two drain ports located on the western side. The drain ports are <br />equipped with valves to open and close the ports, as necessary. Leak detection is by routine visual <br />observation. <br />The secondary containment prevents migration of wastes or accumulated liquids out of the system to <br />the soil, ground water or surface water at any time during use of the tank. The secondary <br />containment is capable of detecting and collecting releases and accumulated liquids through visual <br />inspection until the material is removed. <br />2.7 Hazardous Characteristics of Waste 122 CCR E 66265.191(e)(7)l <br />The tank is used to temporarily store used motor oil from maintenance of the onsite equipment. In <br />accordance with the California Health and Safety Code (HSC) Section 25250. 1, used oil is classified <br />as "any oil that has been refined from crude oil, or any synthetic oil, that has been used, and, as a <br />result of use or as a consequence of extended storage or spillage, has been contaminated by physical <br />or chemical impurities" <br />HSC Section 25250.4 requires that used oil be managed as a hazardous waste in California unless it <br />has been recycled and is shown to meet the specifications for recycled oil in HSC 25250.1 (b), or <br />qualifies for a recycling exclusion under HSC 25143.2. <br />HSC Section 25143.2(b) states that recyclable material that is managed in accordance with Section <br />25143.92 and is or will be recycled by any of the listed methods shall be excluded from classification <br />as a waste. The listed methods include items such as used or reused as an ingredient in an industrial <br />2 Health and Safety Code Section 25143.9 lists requirements for management ofthe material. These <br />requirements include that the material is being held in a container or tank with appropriate labeling, <br />that the business location has a business plan that includes an emergency response plan, and that the <br />material is stored and handled in accordance with all local ordinances and codes (i.e. fire codes). <br />0 0 <br />
