Manifest number 005745909JJK (1/15/11) was found without a signed off copy from the <br />destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the <br />destination facility on site for three years and have them readily available for review. If the generator did <br />not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility <br />to which the generator's waste was submitted within 35 days of the date the waste was accepted by the <br />initial transporter, the generator shall contact the transporter and/or the owner or operator of the <br />designated facility to determine the status of the waste. If the generator did not receive a copy of the <br />signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial <br />transporter, the generator shall submit an Exception Report that includes a legible copy of the missing <br />manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste <br />and the results of those efforts. Exception reports shall be submitted to: <br />DTSC Report Repository <br />Generator Information Services Section <br />P.O. Box 806 <br />Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. <br />By August 1, 2011, submit to the EHD a copy of the signed off copy of the manifest or a copy of the <br />exception report submitted to DTSC. <br />REPEAT VIOLATION <br />Notice to Comply - Minor violations: (7, 15, 45, 64, 85) <br />7. A partially full aerosol can with a broken nozzle was observed in the trash can. Any person who <br />generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposal of <br />aerosol cans, make a hazardous waste determination, and manage them according the Title 22 <br />hazardous waste regulations. The aerosol can was removed from the trash can at the time of <br />inspection. Submit a statement and supporting documentation explaining how this waste was managed <br />by August 1, 2011. <br />15. A spill pallet in the shop under the oil nozzles, a spill pallet outside the shop in the drum storage <br />area, and the spill containment for the used oil totes were observed with standing liquid in the bottom. <br />All facility communications and alarm systems, fire protection equipment, spill control equipment, and <br />decontamination equipment, shall be tested and maintained as necessary to assure its proper operation <br />in time of emergency. Spill containment shall be maintained clean and dry at all times so as to detect a <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122). <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />I Received By: <br />Title: <br />EHD 23-02-008/10/10 / CONTINUATION FORM <br />
