Manifest number 005745909JJK (1/15/11) was found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. By August 1, 2011, submit to the EHD a copy of the signed off copy of the manifest or a copy of the exception report submitted to DTSC. REPEAT VIOLATION Notice to Comply - Minor violations: (7, 15, 45, 64, 85) 7. A partially full aerosol can with a broken nozzle was observed in the trash can. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposal of aerosol cans, make a hazardous waste determination, and manage them according the Title 22 hazardous waste regulations. The aerosol can was removed from the trash can at the time of inspection. Submit a statement and supporting documentation explaining how this waste was managed by August 1, 2011. 15. A spill pallet in the shop under the oil nozzles, a spill pallet outside the shop in the drum storage area, and the spill containment for the used oil totes were observed with standing liquid in the bottom. All facility communications and alarm systems, fire protection equipment, spill control equipment, and decontamination equipment, shall be tested and maintained as necessary to assure its proper operation in time of emergency. Spill containment shall be maintained clean and dry at all times so as to detect a ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122).
