3. Access. At least two (2) business days prior to entry, GSH shall provide <br /> Owner with notice of intent to access the Property and such notice shall include a brief <br /> description of the anticipated work and the time and date(s) thereof. GSH will use <br /> good faith efforts to avoid any unreasonable interference with any tenants or other <br /> users or occupants located on the Property. <br /> 4. Term. This Agreement shall continue until monitoring groundwater at <br /> this location is no longer required by the California Regional Water Quality Control <br /> Board. It is provided, however, that GSH shall have the right to enter the Property after <br /> the well is no longer needed for the limited purpose of completing work to reasonably <br /> restore any disturbed area(s) to a condition similar to the condition before the Work <br /> under this Agreement commenced and abandoning and plugging wells on the Property <br /> upon reasonable notice to Owner. <br /> 5. Compliance with Law/Reclamation. Prior to doing any Work on the <br /> Property, GSH shall obtain the permits required by any regulatory agency, if any, in <br /> connection with its activities hereunder. <br /> 6. Risk of Loss. GSH shall enter upon the Property at its own risk, and <br /> Owner shall not be liable to any of GSH or its agents, successors or assigns, for any <br /> injury or death to persons entering the Property on behalf of GSH pursuant to the <br /> Agreement, or loss or damage to vehicles, equipment, structures or other personal <br /> Property of any nature whatsoever of any of GSH or contractor, or of anyone claiming <br /> by or through any of them, that are brought upon the Property pursuant to this <br /> Agreement, except if such injury, death, loss or damages is caused by the acts or <br /> omissions of Owner. As between Owner and GSH, GSH shall be solely responsible <br /> for any and all costs, expenses, damages and liabilities associated with the Work under <br /> this Agreement. <br /> 7. Interference with Owner's Operations. All activity permitted by this <br /> Agreement shall be carried on in such a manner so as not to unreasonably interfere <br /> with the Property, except to the extent reasonably necessary. GSH's entry upon the <br /> Property shall be coordinated with Owner in such a way as to minimize such <br /> interference. Upon completion of the Work, GSH at its sole cost and expense shall <br /> remove, or cause to be removed, from the Property all equipment and machinery <br /> brought onto the Property by GSH- <br /> 8. Confidentiality, Non-Disclosure and Non-Use. Owner agrees this <br /> Agreement along with any terms, conditions, schedules, exhibits, amendments, <br />
