(b) No use of such historical structure, landmark, or archaeolo- <br /> gical <br /> rchaeolo- <br /> ig cal sites shall detract from or otherwise impair such <br /> structure, landmark, or site as a historical resource, but <br /> rather shall be compatible with and shall complement and <br /> enhance such hisotrical resource. Further, any use of such <br /> historical resource shall be compatible with and not detri- <br /> mental to the surrounding neighborhood; <br /> (c) Parcels with an area less than the minimum area requirements <br /> of the zone in which the historical structure, landmark, or <br /> archaeological site is located may be created for the purpose <br /> of permitting the retention or sale or otherwise transfer of <br /> the site of such historical resource in order to facilitate <br /> the attainment of the objectives of this section. The <br /> minimum area of parcels created under the provisions of this <br /> section for the above purposes shall be determined j?y the <br /> review authority upon reviewing the site plan submitted with <br /> the application for a Use Permit . <br /> SECTION 5 Section 9-3552 , Chapter 12 , Division 3 , Title 9, <br /> of the San Joaquin County Ordinance Code is hereby amended by amending <br /> Subsection (b) to read as follows: <br /> (b) A building or structure occupied by a nonconforming use or a <br /> building or structure nonconforming as to height , area, or <br /> yard regulations may be added to or enlarged or moved to a <br /> new location on the lot only upon approval of a Use Permit , <br /> except as provided for in Section 9-9651 9-3227, Subsection <br /> _Lq)_. Prior to approval of the Use Permit , the review <br /> authority shall find that : <br /> ( 1 ) The addition to, enlargement , or moving of the building <br /> will be in harmony with the purposes and intent of this <br /> Title; <br /> ( 2) The proposed change does not impose any unreasonable <br /> burden upon property located in the vicinity of the non- <br /> conforming use or structure. <br /> SECTION 6 Section 9-4113 , Chapter 2 , Division 4, Title 9 , <br /> of the San Joaquin County Ordinance Code is hereby repealed: <br /> *ReMeebee-le-h -C- 111W Of a Use Permit , alter <br /> uses !n this chaptert may be permitted for tjj,,tu.Ljcaj , <br /> P.L eservL , wCo <br /> tile following conditions. <br /> (et) 9t2ch , <br /> shali have been so designated ar identifled in the Gener <br /> pian,; <br /> TA-88-10 (5th Draft) - 3 - (5-23-88) <br />
