As has been <br /> discussed between members of our respective staffs, the <br /> Department is proposing to modify the terms of an existing <br /> settlement agreement between MCTC and the Department to allow <br /> temporary continued operation of MCTCIs stormwater disposal pond <br /> until August 1, 1986. This pond would continue to receive <br /> hazardous and nonhazardous waste, as defined by the Title 22 , <br /> California Administrative Code, Chapter 30, with the following <br /> conditions: <br /> 1) MCTC must certify compliance with groundwater <br /> monitoring and financial assurance requirements of both <br /> Federal and State law prior to November 8 , 1985. <br /> 2) Prior to November 8, 1985, MCTC will submit a closure <br /> plan in accordance with the requirements of both <br /> federal and state law. The Department proposes to <br /> allow submittal of an adequate closure plan to meet the <br /> requirements for submittal of a Part B application <br /> prior to November 8 , 1985. <br /> Please notify Charles A. White, of my staff, immediately if these <br /> provisions are not acceptable to your agency.
