4.1 LAND USE AND PLANNING POLICY <br /> Beeause the 2010 Plan has net been adepted, its mgulatiens de not have the feree ef law. It is alse the <br /> applicant's intent to preserve the natural area which can be used for educational and research purposes. <br /> Therefore, this impact would->je is considered a less-than-significant impact. <br /> Mitigation <br /> 4.1-4 No mitigation measure is required or recommended. <br /> Impact <br /> 4.1-5 The proposed conservation easement would not adequately protect <br /> the unique on-site resources. <br /> The project applicant is proposing to maintain the riparian woodland as a natural area. A deed of <br /> conservation easement would be prepared and the natural area would be maintained by a third party <br /> conservation agency. The details of how this easement would be implemented and maintained have not <br /> been adequately provided for in the applicant's draft Deed of Conservation Easement. A conservation <br /> easement would preclude development in the natural area, but it would not restrict the activities of future <br /> site residents who would probably use the natural area as their own private wooded preserve. The draft <br /> Deed of Conservation Easement included in the project application does not provide the conservation <br /> agency the ability to restrict the on-site movement of residents or limit access to the natural area. This w <br /> could be detrimental to the unique on-site resources. The proposed conservation easement does ncu <br /> provide adequate long-term protection for on-site resources. (See Biotics and Cultural Resources.) This <br /> is a less-than-significant land use impact. <br /> Mitigation <br /> 4.1-5 The conservation agreement between the applicant and conservation <br /> agency should include language that would restrict access into the <br /> natural area, including access by future residents. This arrangement <br /> would allow the agency or organization a greater ability to protect the <br /> unique on-site resources than is possible with the draft conservation <br /> agreement. <br /> Impact <br /> 4.1-6 The proposed project may create a hazard to aviation in the area. <br /> The Airport Land Use Commission has divided each airport's area of influence into seven subareas where <br /> different standards relating to categories of land use apply. The site is located within the most <br /> 4.1-16 <br />
