4.1 LAND USE AND PLANNING POLICY <br /> unrestricted category, the airport's "Area of Influence." Few restrictions apply within this area. The <br /> Airport Land Use Plan states that proposed communications towers and other very tall structures should <br /> be evaluated to ensure that they will not be aircraft hazards. Proposed dumps and landfills should be <br /> evaluated to ensure that they will not present a bird hazard to aircraft (Airport Plan, page 25). <br /> The project will not contain any towers, dumps or landfills. Discussions with the operators of Lind's <br /> Airport indicate that they do not feel that increased bird activity on the site would effect their operations. <br /> Aircraft have generally reached approximately 1,000 feet in altitude by the time they reach the project <br /> site, reducing the concern about bird hazards (Kupka, 1991). There would be no significant hazard to <br /> aircraft due to the proposed land uses. <br /> Miti ag t <br /> 4.1-6 No mitigation measure is required or recommended. <br /> Impact <br /> 4.1-7 The State Lands Commission has jurisdiction over Tracy Lakes and Jahant Slough. <br /> The project would be subject to SLC permitting process and would have to pay <br /> royalties to the State for any material excavated from the lakes. <br /> The State Lands Commission has jurisdiction over sovereign land underlying the State's navigable <br /> waterways and other resources. Sovereign lands in the project site include the Mokelumne River, and <br /> Enay ineluJahant Slough and Tracy Lakes. The SLC is has indicated <br /> it has jurisdiction over Tracy Lakes (Patterson, April 6, 1992); ifthe .a..`.....,,.7nes that it was <br /> jufisdietieft ever Tr-aey Lakes, any lake excavation will require review and permits from the SLC. The <br /> State would also be entitled to certain fees or royalties on the sale of the excavated material.
