7) Have a preburial agreement. If previously undisclosed archaeological resources are <br /> encountered during construction of any portion of the project, work in the area of the <br /> discoverywill cease. The discovered property will be examinedby a qualified professional <br /> archaeologist,recorded according to accepted contemporary standards,and the impacts <br /> to the site,if any, must be identifiedto determinethe probability limits and importance of <br /> the resource. Such an evaluation may require limited subsurface investigation. <br /> If the discovery involves human remains, applicant will comply with Health and Safety <br /> Code 7050.5 and Public Resources Code 5097. Project work may continue outside known <br /> archaeological resources. <br /> Applicantwill consultwith the San Joaquin County Plan ningCommission,and appropriate <br /> and interested Native American Groups,to develop a plan that will ensure the avoidance, <br /> protection, or scientific and respectful removal of the identified archaeological remains <br /> prior to continued project development in the area of the discovery. <br /> 8) Move any lots that were on midden soils (after the BioSystems survey, two lots were <br /> relocated). <br /> 9) Areas designatedfor storage of excavated soil shall not be located on archaeological sites <br /> of the project. <br /> 10) All sewage leach fields shall be excluded form the area of high archaeological sensitivity. <br /> 11) Native American (Miwok) concerns shall be addressed and development shall be done <br /> with the consultation. An ethnographer shall determine the relationship between these <br /> sites and Miwok oral and traditional history. <br /> 12) A Native American monitor shall be presentduring all land altering or excavation activities <br /> in archaeological site areas as delineated by BioSystems. <br /> 13) A qualified archaeological monitor shall be present during all land altering or excavation <br /> activities. <br /> 14) As perthe BioSystems study,known sites have been mapped by a qualified archaeologist. <br /> 15) The boundaries of archaeological sites as identified in the BioSystems report shall be <br /> fenced when construction is taking place within 100' of said resources. <br /> 16) A survey of the proposed access road south of the river should be completed to avoid <br /> impact to the previous ly-reco rd ed two sites in the vicinity. <br /> Department of Fish and Game Letter,June 15, 1993. <br /> Potentially Significant Impact: Surveys of the federally-threatenedValley Elderberry Longhorn Beetle are <br /> inadequate. <br /> Finding: Changes or alterations have been required in, or incorporated into, the project <br /> which avoid or substantially lessenthe significant environmental effect as identifiedin the <br /> FEIR. These mitigation measures are listed below. <br /> Statement of Fact: This impact will be reduced by the following: <br /> It is the intention of the applicant to avoid, preserve,and enhance Valley Elderberry Longhorn Beetles and <br /> their habitats whenever possible. <br /> 9 <br />
