Prior to recordation of the final map, the applicant will develop a waste diversion analysis <br /> • that outlines the recycling methods, the quantity of waste to be diverted, types of <br /> materials to be recycled and methods to store solid and hazardous waste on site. <br /> In cooperation with the solid waste collection service, appropriate bins for household <br /> recyclable materials will be located at the project site. <br /> An awareness/educational program will be developed by the applicants to encourage <br /> residents to participate in the recycling efforts. <br /> H. BIOLOGICAL RESOURCES <br /> H-1 Potentially Significant Impact: Loss and disruption of nesting and foraging habitat for the <br /> Swainson's hawk. <br /> Development will result in the loss of critical nesting habitat and foraging habitat for the state <br /> threatened Swainson's hawk. Two active nest sites were identified by the EIR biologist, and there <br /> were numerous sitings of Swainson's hawks flying to and from the site and adjacent irrigated <br /> pastures where they were assumed to be foraging. On three occasions Swainson's hawks were <br /> also observed swooping to the ground on site, after what was presumed to be rodent prey. <br /> Development would result in the loss of approximately 124 acres of foraging habitat: <br /> Approximately 49 acres from the creation of homesite parcels bordering the lakes, which provides <br /> optimal rodent (prey) habitat; and approximately 75 acres from the construction of recreational <br /> facilities such as the golf course, tennis courts, and horse stable. <br /> Prior to submittal of any application materials the applicants logged approximately 13 acres of <br /> trees from three portions of the woods to create three fairways for the golf course. This cleared <br /> area comprises approximately 13 acres, and may be considered a taking of habitat for the state <br /> threatened Swainson's hawk pursuant to Section 2080 of the California Fish and Game Code. <br /> Finding: Changes or alterations have been required in, or incorporated into, the project which <br /> avoid or substantially lessen the significant environmental effect as identified in the FEIR. These <br /> mitigation measures are listed below. <br /> Statement of Fact: This impact will be reduced by the following: <br /> Redesign the development so that the golf course and the proposed 26 homesites are <br /> located within the hatched area surrounding North Tracy Lake, shown on Figure 4.7-15 <br /> in the FEIR, with the exception of the area designated as being highly sensitive for <br /> cultural resources. Homesites along the southeast border of the hatched area could <br /> extend to within 300 feet of the northwest shoreline of South Tracy Lake if tall tree screens <br /> are planted to provide a visual barrier between water birds and humans in the area. This <br /> hatched area comprises approximately 170 acres. <br /> Eliminate the proposed access road through Brovelli Woods, which coincides with prime <br /> nesting habitat. <br /> Elimination of the equestrian trail. <br /> Consult with California Department of Fish and Game (CDFG) as required by CDFG <br /> Regulations, Section 2081, with the goal of developing a management plan that will result <br /> in a benefit to the Swainson's hawk. <br /> —9— <br />
