Mr. John Doucette <br />September 28, 1993 <br />Page 2 <br />Hazardous Waste Determination <br />4. ACME violated Title 22, California Code of Regulations <br />(CCR), Section 66262.11, in that on or about <br />May 25, 1993, ACME had failed to determine if waste was <br />hazardous by testing the waste or applying knowledge of <br />characteristics, to wit: ACME had not determined if <br />any of its waste streams were hazardous. <br />Identification Number <br />5. ACME violated Title 22, CCR, Section 66262.12(a), in <br />that on or about May 25, 1993, ACME treated, stored, <br />disposed, transported, or offered for transportation HW <br />without receiving an EPA Identification Number, to wit: <br />ACME had not obtained an EPA Identification Number. <br />Illegal Storage and Treatment <br />6. ACME violated HSC, Section 25201(a), in that on or <br />about May 25, 1993, ACME treated HW without a permit or <br />authorization, to wit: ACME.utilized an oil/water <br />separator for its underground sump. <br />Preparedness and Prevention <br />7. ACME violated Title 22, CCR, Section 66265.32(a), in <br />that on or about May 25, 1993, ACME did not provide an <br />alarm system or internal communications, to wit: no <br />internal communications or alarm system was observed in <br />the hazardous waste generation areas. <br />8. ACME violated Title 22, CCR, Section 66265.35, in that <br />on or about May 25, 1993, ACME had failed to maintain <br />adequate aisle space, to wit: the aisle directly <br />behind the facility, and the aisle on the west side of <br />the facility was very cluttered with equipment and <br />difficult to walk through. <br />9. ACME violated Title 22, CCR, Section 66265.37, in that <br />on or about May 25, 1993, ACME had failed to make <br />arrangements with the police, fire department, <br />emergency response, local hospital, office of Emergency <br />Service, and/or emergency response contractors, to wit: <br />ACME had not made any of the required arrangements. <br />
