ACME violated Title 22, California Code of Regulations (CCR), Section 66262.11, in that on or about May 25, 1993, ACME had failed to determine if waste was hazardous by testing the waste or applying knowledge of characteristics, to wit: ACME had not determined if any of its waste streams were hazardous. Identification Number 5. ACME violated Title 22, CCR, Section 66262.12(a), in that on or about May 25, 1993, ACME treated, stored, disposed, transported, or offered for transportation HW without receiving an EPA Identification Number, to wit: ACME had not obtained an EPA Identification Number. Illegal Storage and Treatment 6. ACME violated HSC, Section 25201(a), in that on or about May 25, 1993, ACME treated HW without a permit or authorization, to wit: ACME.utilized an oil/water separator for its underground sump. Preparedness and Prevention 7. ACME violated Title 22, CCR, Section 66265.32(a), in that on or about May 25, 1993, ACME did not provide an alarm system or internal communications, to wit: no internal communications or alarm system was observed in the hazardous waste generation areas. 8. ACME violated Title 22, CCR, Section 66265.35, in that on or about May 25, 1993, ACME had failed to maintain adequate aisle space, to wit: the aisle directly behind the facility, and the aisle on the west side of the facility was very cluttered with equipment and difficult to walk through. 9. ACME violated Title 22, CCR, Section 66265.37, in that on or about May 25, 1993, ACME had failed to make arrangements with the police, fire department, emergency response, local hospital, office of Emergency Service, and/or emergency response contractors, to wit: ACME had not made any of the required arrangements.
