ACME violated Title 22, CCR, Section 66265.173(x), in <br />that on or about May 25, 1993, ACME failed to keep <br />containers of HW closed except when adding or removing <br />HW, to wit: Two 55 -gallon drums of waste oil were <br />observed opened. <br />11. ACME violated Title 22, CCR, Section 66265.174, in that <br />on or about May 25, 1993, ACME failed to inspect areas <br />where containers were stored or transferred at least <br />weekly, looking for leaking containers and <br />deterioration of containers and containment system, to <br />wit: ACME did not have any inspection records. <br />Pre -Transportation Requirements <br />12. ACME violated Title 22, CCR, Section 66262.30, in that <br />on or about May 25, 1993, and for approximately three <br />years prior to this date, ACME failed to package HW per <br />U. S. Department of Transportation (49 CFR Parts 173, <br />178, 179) before offering HW for transportation <br />off-site, to wit: ACME failed to package HW per DOT <br />before offering waste oil to -its employees. <br />13. ACME violated Title 22, CCR, Section 66262.34(e)(3), in <br />that on or about May 25, 1993, ACME failed to mark <br />Container of HW at point of generation (i.e., satellite <br />accumulation area) with the date the quantity limit was <br />reached within three days, to wit: ACME failed to <br />label any of the containers. <br />14. ACME violated Title 22, CCR, Section 66262.34(f)(2), in <br />that on or about May 25, 1993, ACME failed to mark the <br />generation start date on each containers and portable <br />tank on the 90 -day accumulation area, to wit: ACME <br />failed to mark the generation start date on all of the <br />55 -gallon oil waste drums. <br />15. ACME violated Title 22, CCR, Section 66262.34(f)(3), in <br />that on or about May 25, 1993, ACME had failed to label <br />each container and tank of HW with the word "Hazardous <br />Waste", to wit: ACME failed to label all containers of <br />HW with the word "Hazardous Waste". <br />16. ACME violated Title 22, CCR, Section 66262.34(f)(3), in <br />that on or about May 25, 1993, ACME failed to label <br />containers of HW with the composition and physical <br />
