ACME violated Title 22, CCR, Section 66261.7(f), in <br />that on or about May 25, 1993, ACME failed to mark <br />containers or inner liners greater than five gallons <br />with date emptied and managed pursuant to 66261.7(e) <br />within one year of date emptied, to wit: ACME failed <br />to mark two empty 55 -gallon drums accordingly. <br />Tanks <br />18. ACME violated Title 22, CCR, Section 66265.191(a), in <br />that on or about May 25, 1993, ACME had failed to <br />determine whether tank was leaking or unfit, failed to <br />keep written integrity assessment certified by a <br />registered professional engineer for tanks without <br />secondary containment, to wit: ACME had failed to <br />assess the underground tank's integrity and did not <br />provide secondary containment. <br />Manifest System <br />19. ACME violated Title 22, CCR, Section 66262.20(a), in <br />that on or about May 25, 1993, and approximately three <br />years prior to this date, ACME failed to prepare a <br />complete manifest for HW transported or sent off-site, <br />to wit: ACME failed prepare a complete manifest prior <br />to offering oil waste to its employees for disposal <br />off-site. <br />Recordkeeping and Reporting <br />20. ACME violated Title 22, CCR, Section 66262.41(a), in <br />that on or about May 25, 1993, ACME failed to send the <br />Department a Biennial Report, to wit: ACME had not <br />prepared or sent a Biennial Report to the Department. <br />Contingency Plan and Emergency Procedures <br />21. ACME violated Title 22, CCR, Section 66265.51(a), in <br />that on or about May 25, 1993, ACME did not have a <br />contingency plan, to wit: ACME did not have a <br />contingency plan. <br />
