r <br /> The following is an itemized list of hazardous waste violations that have not been addressed <br /> for Quick Stop Mart as of June 09, 2015. <br /> Open violations from December 30, 2014 inspection <br /> Violation#301 -UST system is not operated to prevent unauthorized release, including spills and <br /> overfills. <br /> The facility has been locked and business closed; therefore the underground storage tank(UST)system is not <br /> being monitored that will prevent unauthorized releases. UST system shall be operated to prevent unauthorized <br /> releases. Immediately arrange to provide continuous monitoring of the UST system, or submit to EHD a <br /> completed UST removal permit application if the UST will no longer be operated, or a temporary UST closure <br /> permit application if the UST system is to return to operation within one year of cessation. This is a Class II <br /> violation. <br /> Violation#2030-Unlisted Operations/Maintenance violation. <br /> The referenced business was verified closed with no one present to facilitate continuous monitoring of the UST <br /> system; therefore the UST system is considered illegally abandoned. According to California Health and Safety <br /> Code(HSC) Section 25298(a), no person shall abandon an UST system. Immediately submit a completed <br /> permit application to have the USTs removed along with appropriate fee to EHD; a temporary tank closure permit <br /> may be submitted in lieu of tank removal if the UST system is to return to operation (and monitored)within one <br /> year of end of operation. This is a Class II violation. <br /> Open violations from April 7, 2014 inspection <br /> Violation#101 -No permit to operate <br /> Violation#102-Annual operating fees not paid <br /> Fees for the 2014 annual permit to operate the UST system have not been paid. No person may own or operate <br /> an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the UST <br /> system. Immediately contact the EHD accounting office to make arrangements for payment to obtain a permit to <br /> operate a UST system. <br /> Violation#104-Current financial responsibility documents not on file with the Environmental Health <br /> Department(EHD) <br /> Financial responsibility documents have not been submitted to the EHD. The most recent financial responsibility <br /> documents on record are incomplete and dated April 1, 2013. Current financial responsibility documents are <br /> required to be submitted annually. Immediately submit a copy of the financial responsibility documents to the <br /> EHD. Alternatively, log into CERS, upload the required information, and submit for review by the EHD. REPEAT <br /> VIOLATION <br /> Violation#105-Current Unified Program Consolidated Forms not on file with the EHD (Facility and tank <br /> form) <br /> UST Facility Operating Permit Application and UST Tank Information for the 87 and 91 tanks are not submitted in <br /> CERS. Any change of information must be updated in CERS within 30 days of the changes. Immediately log into <br /> CERS, update the required information, and submit for review by the EHD. Complete a separate tank form for <br /> each tank. <br /> Violation#106 - Monitoring Program (Monitoring & Response Plans) is not current or approved by the <br /> EHD <br /> Violation#202-Monitoring plan, response plan,and/or operating permit and all conditions not onsite <br /> Current approved copies of the monitoring and response plans were not found on site. The monitoring and <br /> response plans must be current and approved by the EHD. Immediately log into CERS, update the monitoring <br /> plan information, and submit for review by the EHD. Complete a monitoring plan record for each tank. <br /> Immediately submit a copy of the response plan to the EHD for approval. Alternatively, log into CERS, upload the <br /> completed form, and submit for review by the EHD. Maintain an approved copy on site. <br /> Page 5 of 7 <br />
