0 <br />0 <br />F__j <br />7� j <br />JUN 2 9 2016 <br />This is a repeat violation, Class II. <br />This information has been changed in CERS and submitted for review. <br />Failed to test secondary containment. <br />Secondary containment testing was performed late. The previous test was conducted on 7- <br />27-2011 and was due by 8-27-2014. The secondary containment testing was conducted on <br />11-06-13 (passing results for UDC -13, UDC 14-15, and UDC -16 only were received), and on <br />8-19-14 for all remaining components with the exception of UDC -13, UDC 14-15, and UDC - <br />16 (tested on 11-06-13). Secondary containment testing is required once every 36 months. <br />The secondary containment testing for UDC -13, UDC 14-15, and UDC -16 is due by 11-16- <br />2016 and for the rest of the components by 7-27-17. Take all necessary precautions to <br />ensure testing is performed in a timely manner. <br />This is a Class 11 violation. <br />Although some of the components were tested at different times, it is Pilot's position that all <br />components were tested prior to the due date of 8-27-2094, and therefore not late. The SB - <br />989 testing was incomplete when Pilot took over this site in 2090, and Pilot and Jones Covey <br />Group, inc. worked with the EHD to complete testing, repairs, and retesting, and to ensure <br />compliance with all applicable regulations going forward. All SB -989 testing will be <br />completed prior to the deadline and submitted to the EHD. <br />Permit to repair UST system not obtained. <br />The concrete was broken in the vicinity of the "auto side" UDCs and fuel piping and a permit <br />was not obtained from the EHD. Emergency repairs relating to the UST system monitoring <br />and release detection may be performed by a properly licensed, trained, and certified <br />contractor pursuant to the EHD's policy and a permit obtained within one business day from <br />the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to <br />beginning work. Immediately obtain a permit from the EHD for these repairs. An incomplete <br />permit application was received on 5-6-16; immediately submit the complete permit <br />application to the EHD. A "Failure to Obtain a Permit" penalty applies. <br />This is a Class II violation. <br />Please see the attached permit application submitted by Franzen Hill Corporation, revised <br />and approved by the EHD. The referenced work noted during the inspection was unrelated <br />to scheduled UST compliance testing and being performed under a separate scope of work. <br />It is Pilot's understanding that Franzen Hill personnel have been in communication with the <br />EHD on this matter to return to compliance. <br />Current monitoring plan approved by the EHD not found on site. <br />An approved copy of the monitoring plans were not available for inspection. The monitoring <br />plan uploaded into CERS for the onsite oil water separator is not current and/or not approved <br />by the EHD. The monitoring plan for the onsite oil water separator indicates that the leak <br />alarm triggers the automatic pump shut down and failure or disconnection of the sensor also <br />triggers an automatic pump shut down. A copy of these plans shall be accessible on site at <br />all times. Immediately make the necessary corrections and retain a copy on site. <br />This is a Class 11 violation. <br />
