4. The City shall adopt such rules and regulations for the operation and maintenance of the garbage and refuse disposal facility herein provided for as may be necessary to facilitate and assist in the operation of said facility. 5. Daring the time that this agreement is in effect the City shall encourage the use of the garbage and refuse disposal facility herein provided for by scavengers, refuse and garbage collectors and members of the public, by such means and in such manner as may be authorized by law. 6. The City shall not be liable or responsible for any accident, loss, injury or damages happening or accruing during the time this agreement is in effect by reason of the establishment, operation or maintenance of the garbage and refuse disposal facility herein referred to and in connection therewith to persons and/or property, and the Contractor shall fully indemnify and protect the City from and against the same. In addition to the liability imposed by law upon the Contractor for injury (including death) to persons or damage to property by reason of the negligence of the Contractor or his agents, which liability is not impaired or otherwise affected hereby, the Contractor hereby assumes liability for and agrees to save the City harmless and indemnify it from every expense, liability or payment by reason of any injury (including death) to persons or damage to property suffered through any act or omission of the Contractor or any of his agents, servants or employees, or anyone directly or indirectly employed by any of them; or arising in any vay from the establishment, operation or maintenance of said garbage and refuse disposal facility pursuant to this agreement. As a further precaution toward this end, the Contractor shall procure and maintain in full force and effect during the time that this agreement is in effect, insurance in his favor with an insurance carrier approved by the City as follows: At least in the amount of ONE HUNDRED THOUSAND DOLLARS ($100,000.00) covering all of the risks named in this paragraph, excepting Public Liability, which shall be at least in the sum of ONE HUNDHIM THOUSAND DOLLARS ($100,000.00) in any one accident involving any one person, and THRM HUNDRED THOUSAND DOLLARS ($300,000.00) in any one accident involving more than one person, where accidents (including death) occur to persons, the City's agents and employees, the Con- -5-
