Go. - <br />SUBJECT: EMERGENCY REGULATIONS FOR THE PERMITTING OF WASTE TIRE <br />The' -emergency regulations for the permitting of waste tire <br />facilities were filed with the Secretary of State on February 10, <br />1992. .The regulations became effective immediately upon filing. <br />Under Chapter 16, the Board is vested with the responsibility for <br />the administration of waste tire programs. Specifically, the <br />Board must -protect public health, safety, and the environment by <br />establishing standards and a permitting program for facilities <br />that store or dispose of waste tires. <br />The subject regulations: <br />• Set forth permitting procedures for major (5,000 or <br />more waste tires) and minor (500 to 4,999 waste tires) <br />WTF°s. <br />• Establish financial assurance and elimination/reduction <br />requirements for major WTF's. <br />• Establish closure and inspection requirements for all <br />WTF°s. <br />• Establish minimum standards for the outdoor and indoor <br />storage of waste tires. Standards include requirements <br />for fire prevention, facility access and site security, <br />vector control measures, storage of waste tires at <br />waste fire facilities, and storage and disposal of <br />waste tires at permitted -solid waste facilities. <br />• Allow landfills to store waste tires. <br />Key statutory and regulatory dates are listed below: <br />• on•or after July 1, 1992, no person shall establish a <br />new major WTF or expand an existing minor WTF without <br />first obtaining a permit from the Board. <br />• On or after September 1, 1993, it is unlawful to direct <br />or transport waste tires to a major WTF or to accept <br />waste tires at a major WTF unless the operator has <br />obtained a major WTF permit. <br />Printed on Resiled Paper •- <br />• <br />
