3.4. 1 Excavation Safety <br /> Excavations performed on-site by the Operator shall conform to <br /> regulations in Title 8, Article 6, Excavation Trenches Earthwork <br /> In addition, the County will perform periodic site inspections to <br /> review excavation techniques and slopes. The County reserves the <br /> right under this agreement to limit the excavation practices or <br /> slopes by the Operator at its discretion. This direction shall in <br /> no way supersede minimum requirements of CCR or CAL OSHA mentioned <br /> above. <br /> The Operator shall be responsible for compliance with appropriate <br /> state and local excavation permitting and safety regulations. <br /> Costs for obtaining all permits, and for payment of fines which may <br /> result from inspections or actions by CAL OSHA or other regulatory <br /> agencies will be the sole responsibility of the Operator. It is <br /> the responsibility of the Operator to comply with the latest health <br /> and safety regulations pertaining to site excavation. <br /> 3.4.2 Stockpiling <br /> Stockpiling of soil resulting from excavations will be according to <br /> stockpiling plans developed by the County. The stockpile plans <br /> will be prepared by the County by August 1 of each year. The plans <br /> will show the limits and proposed grades for the stockpile on a <br /> landfill map, to scaled and shall contain an estimate of the <br /> stockpile volume, proposed location for soil use, and life of the <br /> stockpile. <br /> 3.5 Quality and grade control <br /> 3.5. 1 Excavation Quality Control <br /> The County will direct the Operator on the quality requirements for <br /> 8 <br />
