Where existing fencing is used or modified for security fence, restore to original condition at completion of the Work. 3.2 SAFETY AND PROTECTION A. Safety Requirements: 1. CONTRACTOR shall do whatever Work is necessary for safety and be solely and completely responsible for conditions of the jobsite, including safety of all persons (including employees) and property during the Contract period. This requirement shall apply continuously and not be limited to normal working hours. 2. Safety provisions shall conform to Federal and State Departments of Labor Occupational Safety and Health Act (OSHA), and other applicable federal, state, county, and local laws, ordinances, codes, requirements set forth herein, and regulations that may be specified in other parts of these Contract Documents. Where these are in conflict, the more stringent requirement shall be followed. CONTRACTOR shall become thoroughly familiar with governing safety provisions and shall comply with the obligations set forth therein. 3. CONTRACTOR shall develop and maintain for the duration of the Contract, a safety program that will effectively incorporate and implement required safety provisions. CONTRACTOR shall appoint a qualified employee who is authorized to supervise and enforce compliance with the safety program. 4. OWNER, DESIGN ENGINEER, or QA/QC CONSULTANT's duty to conduct construction review of the CONTRACTOR's performance is not intended to include a review or approval of the adequacy of CONTRACTOR's safety supervisor, safety program, or safety measures taken in, on, or near the construction site. 5. As part of safety program, CONTRACTOR shall maintain at its office or other well-known place at the jobsite, safety equipment applicable to the Work as prescribed by the governing safety authorities, and articles necessary for giving first-aid to the injured. Establish procedures for the immediate removal to a hospital or a doctor's care of persons who may be injured on the jobsite. 6. Comply with OWNER's safety rules while on OWNER's property. 7. If death or serious injuries or damages are caused, the accident shall be reported immediately by telephone or messenger to the OWNER. In addition, CONTRACTOR shall promptly report in writing all accidents whatsoever arising out of, or in connection with, the performance of the Work whether on or adjacent to the site, giving full details and statements of witnesses. 8. If claim is made by anyone against CONTRACTOR or any subcontractor on account of accident, CONTRACTOR shall promptly report the facts in writing, giving full details of the claim. B. Fire Prevention: Perform all Work in a firesafe manner. C. Protection of Work and Property: 1. General: CONTRACTOR shall employ such means and methods necessary to adequately protect public property and property of the OWNER against damage.
