Consolidated Forward Inc. Landfill <br />Page 23 <br />Prior to initiation of any activity within a 100 foot radius of a valley oak proposed for <br />retention, the project proponent shall install clearly visible temporary fencing around the <br />dripline of the Valley oak to prevent inadvertent damage during on-site activities. Fencing <br />shall be removed upon completion of activity within the oak's vicinity. Site workers shall be <br />advised of the sensitivity of on-site oaks to disturbance. <br />68 Austin 1994 (F2.c) (similar), Austin 2000 (F2.c) <br />Where avoidance of a valley oak(s) as specified above is determined infeasible, the project <br />proponent shall replace each oak as required by the County's Natural Resources Regulations: <br />three oaks shall be planted in appropriate locations for each oak removed. Replacement trees <br />shall be the same species as the removed trees. Replacement trees shall be planted on the site <br />in association with the Wetland Mitigation and Monitoring Plan described above. <br />69 Austin 1994 (F2.d) (similar), Austin 2000 (F2.d) <br />To ensure the success of mitigation, planted and retained trees shall be monitored for a period <br />of five years following initial disturbance within the vicinity of a retained tree or following <br />planting of a replacement tree. If, during the course of monitoring, a significant decline in <br />the health of planted or retained trees is identified by a qualified arborist, the tree shall be <br />replaced as described above. <br />70 Austin 1994 (F3.a) (similar), Austin 2000 (similar) (F3.a) <br />Of the 219 acres disturbed, a 10.5 -acre wildlife preserve and floodplain will be retained as <br />foraging habitat. <br />71 Austin 2000 (F4.a) (updated) <br />Expansion of the landfill into the [Austin Road] Expansion Area shall be preceded by a <br />nesting survey for Swainson's hawks during the breeding season in order to document the <br />presence, location and number of Swainson's hawks nests near or within the Landfill. These <br />nests and other detected nests shall be monitored yearly to document the effect if any of the <br />landfill operations on the presence of breeding Swainson's hawks and on the success of <br />breeding Swainson's hawks. <br />72 Austin 2000 (F7.a) <br />According to the SJMSCP, the mitigation fee for conversion of agricultural lands to other <br />uses is $1,500 per acre. For the conversion of 213.9 acres of Agricultural Lands, the County <br />shall pay $320,850 to the SJMSCP Joint Powers Authority to fund acquisition of preserve <br />lands for covered species that could potentilly be affected. <br />73 Austin 2000 (F14.a) <br />Pre -construction surveys for greater western mastiff bat should be conducted prior to <br />removing any trees from the project site. These pre -construction surveys may be required <br />and funded by the SJMSCP JPA and should be conducted by a biologist with experience <br />surveying for bats, and the surveys should not occur any more than 30 days prior to the <br />proposed tree removal. If no special -status bats are identified during the pre -construction <br />survey(s), then no impacts to these bats would be expected to occur from construction of the <br />proposed project. If, however, greater western mastiff bat is identified in any of the trees <br />proposed for removal, reproductive status should be determined. <br />
