f)R <br /> e <br /> On June 1, 2004, Robert McClellon and Michael Kith employees of the EHD made an <br /> inspection at the ESTRF. The inspection was allowed, but the EHD staff could not take <br /> any photos during the inspection. The green waste was heavily contaminated with food <br /> waste, baby diapers and other putresible solid wastes. The EHD staff attempted to <br /> conduct a follow up inspection later that week and was refused access to the facility. <br /> Robert McClellon reviewed the ESTRF file and found a restriction in the Use Permit that <br /> would preclude the ESTRF from receiving putresible wastes. Robert McClellon <br /> forwarded this information on to Randy Friedlander CIWMB staff that inspects the <br /> facility. Mr. Friedlander indicated he would look in to it. (see exhibit U). <br /> On June 1, 2004, the EHD received an e-mail from Kevin Basso. The e-mail indicated <br /> that the Forward Inc. would be taking the green waste into the ESTRF for processing (see <br /> exhibit V). <br /> On or about June 3, 2005, a meeting was held at the EHD. Kevin Basso, Kevin Chiapello, <br /> and Butch Stephani of Forward Inc were present. Robert McClellon, Michael Kith and <br /> Ted Tasiopoulis were present from the EHD. The issue was the green waste contaminated <br /> with food waste that they were taking to ESTRF for processing. Kevin Basso informed <br /> the EHD that it just made sense from a monetary standpoint to have ESTRF handle the <br /> material. Robert McClellon explained that I did not have any inspection authority and <br /> that it would preclude the EHD from evaluating the effectiveness of the sorting process. <br /> Robert McClellon informed Mr. Basso that the ESTRF was in violation of it's Use Permit <br /> • by accepting the material. Kevin Basso indicated that he was not aware of that but that he <br /> would need to hear it from the management at ESTRF. Mr. Basso indicated that he was <br /> going to continue to take the material there until they were told they could not. Robert <br /> McClellon offered Mr. Basso a copy of the Use Permit and he indicated that he did not <br /> want to get involved. Mr. Basso also indicated that he was only handling 50% of the <br /> green waste generated by the City of Stockton and was curious as to where Stockton <br /> Scavengers was taking it. <br /> On June 3, 2005 Robert McClellon spoke with Brain Bowen of Waste Management Inc. <br /> regarding the green waste that was being handled by Stockton Scavengers. He indicated <br /> that it was going Forward Inc. for disposal. <br /> On June 17, 2004,the EHD conducted a joint inspection of the ESTRF with the Randy <br /> Friedlander of the CIWMB staff. The facility was cited for a violation of the terms and <br /> conditions for accepting the putresible waste. The operators of the ESTRF began to turn <br /> the green waste trucks away. The green waste was then routed to the Forward Inc <br /> Resource Recovery Facility for sorting. <br /> On June 23, 2004, Randy Friedlander forward the EHD photos that were taken during the <br /> inspection at the ESTRF on June 17, 2004 (see exhibit W). <br /> Between June 25, 2004 Michael Kith and Ted Tasiopoulis employees of the EHD <br /> conducted a monthly routine inspection and noted that the concentrations of methane gas <br /> • in the gas monitoring probe GP-9 ranged from 50% to 58%. This was documented under <br />
